THE THINKER: DIFFICULT, NOT IMPOSSIBLE

Una democracia republicana, para serlo realmente y no en apariencia, o sea para funcionar como debe, ha de asentarse en la independencia de tres Poderes esenciales que se relacionan para consolidarla: el Ejecutivo, el Legislativo y el Judicial.

A republican democracy, to be really and not in appearance, that is to say to function as it should, must be based on the independence of three essential Powers that are related to consolidate it: the Executive, the Legislative and the Judicial.

Cuando por circunstancias que se presentan a través del tiempo en algunos de ellos, sin solución de continuidad, esa independencia tambalea y causa rispideces que entorpecen el normal funcionamiento del régimen democrático.

When, due to circumstances that arise over time in some of them, without interruption, that independence falters and causes harshness that hinders the normal functioning of the democratic regime.

En estos días los ciudadanos contemplan, y quiero creer que en su mayoría con preocupación, discusiones acerca de un asunto –no es el único, claro, pero en favor de la síntesis, por su actualidad, lo usaré como ejemplo- que podría, erróneamente, ser considerado menor. El Parlamento aprobó una ley para regular los ascensos y traslados en el Poder Judicial. A renglón seguido, la Suprema Corte de Justicia sentenció que la misma es inconstitucional. De algún modo, como escribió en Búsqueda mi colega y amigo Raúl Ronzoni, que de esto sabe mucho más que yo, “se opuso a que los mecanismos de selección a los cargos de jueces puedan realizarse mediante una decisión política, porque el Poder Judicial es el que debe arbitrar las normas que considere adecuadas o necesarias”.

These days citizens contemplate, and I would like to believe that most of them with concern, discussions about an issue -it is not the only one, of course, but in favor of synthesis, due to its relevance, I will use it as an example- that could, erroneously be considered minor. Parliament approved a law to regulate promotions and transfers in the Judiciary. Subsequently, the Supreme Court of Justice ruled that it is unconstitutional. Somehow, as my colleague and friend Raúl Ronzoni, who knows much more about this than I, wrote in Search, «he opposed the selection mechanisms for the positions of judges being carried out through a political decision, because the Judiciary is the one that must arbitrate the norms that it considers adequate or necessary”.

Todo este lío comenzó en 2019, cuando el Poder Legislativo modificó la Ley Orgánica de la Judicatura y Organización de los Tribunales, con normas que fueron de inmediato cuestionadas por la Suprema Corte, que recién ahora decidió sobre su inconstitucionalidad.

All this mess began in 2019, when the Legislative Power modified the Organic Law of the Judiciary and Organization of the Courts, with regulations that were immediately questioned by the Supreme Court, which only now decided on its unconstitutionality.

La cosa se complicó cuando la Asociación de Magistrados Judiciales del Uruguay, y hasta algunos fiscales, respaldaron esa ley y le exigieron a la Corte un sistema transparente y objetivo para designaciones y ascensos, a lo que aquella respondió que “se estaba violentando el principio de la separación de Poderes”.

Things got complicated when the Association of Judicial Magistrates of Uruguay, and even some prosecutors, supported that law and demanded from the Court a transparent and objective system for appointments and promotions, to which the former responded that «the principle of the separation of Powers”.

En criollo básico, éste es un nudo bastante intrincado que no será sencillo desatar. Mientras tanto, se postergan otros problemas de la Justicia que debieran mirarse antes: la mejora de su infraestructura, el aumento de sus recursos humanos y económicos y la corrección del Nuevo Código del Proceso Penal que, como he dicho, y me hago cargo, es un absurdo, desprolijo y ambiguo camino hacia una supuesta mayor agilidad del sistema que sólo ha conseguido un consenso de dudas y sospechas.

In basic Creole, this is a rather intricate knot that will not be easy to untie. Meanwhile, other problems of Justice that should be looked at first are being postponed: the improvement of its infrastructure, the increase in its human and economic resources and the correction of the New Code of Criminal Procedure which, as I have said, and I accept, is an absurd, untidy and ambiguous path towards a supposed greater agility of the system that has only achieved a consensus of doubts and suspicions.

Hay tres aspectos que deseo considerar, lector, antes de cerrar esta reflexión.

There are three aspects that I wish to consider, reader, before closing this reflection.

Primero, la independencia del Poder Judicial no es tal, en tanto muchas decisiones que lo afectan dependen de decisiones legislativas. Principalmente, su presupuesto.

First, the independence of the Judiciary is not such, as many decisions that affect it depend on legislative decisions. Mainly, your budget.

Segundo, la mayoría de los políticos –no la política como principio que se supone representan- está muy alineada, sin distinciones partidarias, en intentos diversos de influir en ese Poder Judicial.

Second, the majority of politicians -not politics as a principle that they are supposed to represent- are very aligned, without partisan distinctions, in various attempts to influence that Judiciary.

Tercero, creo que lo más relevante, luego de leer con atención la Constitución de la República vigente y las leyes más recientes que le añaden matices, advierto que la cuestión se complica mucho más, porque la incidencia política está allí, de un modo u otro, y más allá de la rimbombante declaración de “independencia judicial”, también consagrada e impregnándolo casi todo. Acepto desde ya, por mi falta de especialización técnica en el asunto, la posibilidad de estar equivocado. Pero, por ahora, mi inquietud crece a diario y me asusta lo que puede venir.

Third, I think that the most important thing, after carefully reading the current Constitution of the Republic and the most recent laws that add nuances to it, I notice that the issue is much more complicated, because the political incidence is there, in one way or another , and beyond the bombastic declaration of «judicial independence», also enshrined and permeating almost everything. I accept from now on, due to my lack of technical specialization in the matter, the possibility of being wrong. But for now, my restlessness grows daily and I am scared of what may come.

Finalmente, como argumentó Ronzoni, recordando de paso las diferencias de opinión técnica no sólo entre los legisladores, más allá de su interés político coincidente, sino entre los propios constitucionalistas que han sido consultados, “hay discusión para rato”.

Finally, as Ronzoni argued, recalling in passing the differences of technical opinion not only among legislators, beyond their coincident political interest, but among the constitutionalists themselves who have been consulted, «there is discussion for a while.»

Mientras tanto, los procesos judiciales siguen a paso de tortuga, el Nuevo Código del Proceso Penal sigue fomentando con sus fallos debates públicos desde dramáticos a divertidos, y crece la desconfianza de la persona de a pie en el Poder que, y eso sí lo saben todo, descansa la defensa o la punición vinculada al ejercicio de todos sus derechos y obligaciones.

Meanwhile, the judicial processes continue at a snail’s pace, the New Code of Criminal Procedure continues to encourage public debates with its rulings, ranging from dramatic to amusing, and the distrust of the ordinary person in power who, and they do know that, is growing everything rests the defense or punishment linked to the exercise of all their rights and obligations.

Es decir, a su libertad responsable.
