When death fails, should one try again?

COLUMNISTA
Christa Gail Pike had a date with death.
On September 30, 2026, the state of Tennessee attempted to execute—via lethal injection—this 50-year-old woman, who had been convicted of the 1995 murder of Colleen Slemmer.
I do not intend to downplay the gravity of that crime. There was a victim, a family was destroyed, and a conviction was handed down.
But something happened that compels us to re-examine one of our society’s most debated forms of punishment.
La ejecución falló.
The execution failed.

Pike received two doses of pentobarbital, the drug Tennessee uses to induce death. Yet, she continued to breathe. The procedure reached the limits allowed by protocol, and ultimately, she had to be transferred from the prison to a hospital.
It later emerged that she was unconscious, intubated, and on a ventilator while receiving life-sustaining care.
In other words: the State tried to kill her, and hours later, doctors were fighting to save her.
Her lawyers claim there were issues with the IV lines and that some of the drug may have leaked into the surrounding tissue, causing inflammation, burns, and blisters on her arms. These circumstances are now part of an investigation and should not yet be treated as a definitive conclusion.
Tennessee Governor Bill Lee suspended the remaining executions scheduled through 2026 and ordered an independent investigation. Even the Commissioner of the Department of Correction, Frank Strada, subsequently announced his resignation.
But there is a question that no protocol can easily answer:
¿Qué hacemos si esta mujer sobrevive?
What do we do if this woman survives?
Yo no soy médico.
I am not a doctor.
No puedo afirmar si tendrá daño cerebral, cardíaco, pulmonar, renal o cualquier otra consecuencia permanente.
I cannot say whether she will suffer brain, heart, lung, or kidney damage, or any other permanent consequence. Nor can I determine right now if she will fully regain consciousness.
Eso le corresponde a los médicos.
That is for the doctors to decide.
But one thing is clear: a person who, following a botched execution, ends up unconscious, intubated, and dependent on a ventilator did not leave that room the same way she entered it.
Y entonces aparece otra pregunta, todavía más incómoda:
And then another, even more uncomfortable question arises:
¿Volvemos a intentarlo?
Do we try again?
Do we revive her in a hospital, only to place her back on a gurney and administer another substance to see if, this time, we actually manage to kill her?
Para mí, no.
For me, the answer is no.
Pike committed a terrible crime and was convicted for it. I am not asking for the victim to be ignored or for the punishment to be waived.
I am questioning something else: the State’s right to decide when a person should die.
I have never believed in the death penalty.
Creo en la vida.
I believe in life.
If a person poses a danger to society, let them remain locked up. If the crime warrants a life sentence, let them serve a life sentence. Let them grow old behind bars if that is what justice dictates.
Pero que muera cuando le corresponda morir.
But let them die when their time comes.
Not when an official looks at a calendar and says: «You are going to die on Wednesday at seven in the evening.»
Because then a contradiction arises that I have never been able to accept.
Decimos que matar es incorrecto.
We say that killing is wrong.
We condemn a person because they took a life.
And, to show them that taking a life is wrong, do we take theirs?
The law may establish legal distinctions between murder and a state-sanctioned execution.
Moralmente, para mí continúa existiendo una pregunta:
Morally, for me, a question remains:
Who are we to decide the final minute of another human being’s life?
Y existe, además, otra razón que me preocupa profundamente.
And there is, moreover, another reason that deeply concerns me.
Los sistemas judiciales se equivocan.
Judicial systems make mistakes.
There are people who have spent years in prison only to be exonerated later. Some came dangerously close to receiving an irreversible sentence before a piece of evidence, a testimony, a DNA analysis, or some other factor emerged to prove that a mistake had been made.
That is precisely what I have written about before: the innocent person walking toward death while hoping that, at the very last moment, something will appear to prove they never should have been there.
Una sentencia de prisión puede ser revisada.
A prison sentence can be reviewed.
Se puede abrir una puerta.
A door can be opened.
Se puede declarar una condena injusta.
A conviction can be declared unjust.
Compensation can be awarded, even if the lost years can never be fully restored.
But there is one thing no judge, governor, president, prosecutor, or court can do: bring an innocent person back to life after executing them.
That is why I would rather be wrong by keeping a guilty person alive in prison than discover too late that the State killed an innocent person.
In Christa Pike’s case, we are not talking about a claim of innocence. We are talking about something else: she survived the procedure designed to end her life.
Fue llevada a aquella habitación.
She was taken to that room.
Fue sujetada a aquella camilla.
She was strapped to that gurney.
Recibió las sustancias.
She received the substances.
Y sobrevivió.
And she survived.
Ella no diseñó el protocolo.
She did not design the protocol.
Ella no colocó las vías intravenosas.
She did not insert the IV lines.
Ella no preparó los medicamentos.
She did not prepare the drugs.
Ella no decidió cómo debía funcionar la ejecución.
She did not decide how the execution should be carried out.
El Estado lo hizo.
The State did that.
If there was a failure, it was not the condemned woman’s fault.
Now Pike is in a hospital while others try to remedy, as best they can, what happened.
Para mí, eso debería ser suficiente.
For me, that should be enough.
Let her remain imprisoned if her sentence dictates it. Let her never walk free on the street again if justice deems she must serve a life sentence.
Pero no vuelvan a llevarla a aquella camilla.
But do not take her back to that gurney.
Because when a society needs to try to kill a person twice to prove it is administering justice, perhaps the time has come to ask ourselves if that is still justice.
I do not believe in death as a punishment.
I believe that those who commit a crime must answer for it.
I believe society has the right to protect itself.
Creo en la prisión cuando sea necesaria.
I believe in imprisonment when necessary.
But I also believe there is a line that we, as human beings, should not cross.
No somos dioses.
We are not gods.
We cannot restore a life once we have taken it.
That is why, between a locked cell and a gurney prepared for killing, I choose the cell.
Que cumpla su condena.
Let her serve her sentence.
And let death come when it is meant to come, not when the State decides to set a day and time for it.
