THE THINKER: NO SHORTCUTS

En el contexto de lo que, más de una vez, he llamado la degradación creciente que sacude a nuestra sociedad, no desestimo pero presto relativa atención a las estadísticas sobre la disminución de los delitos: homicidios, violencia doméstica o contra minorías, rapiñas, narcotráfico y tantos más.

In the context of what, more than once, I have called the growing degradation that shakes our society, I do not dismiss but I pay relative attention to the statistics on the decrease in crimes: homicides, domestic violence or against minorities, robberies, drug trafficking and so many more.

Por supuesto que es importante que baje ese porcentaje, aunque huelga decir que se está hablando, supuestamente, de la eficacia de las acciones preventiva y represiva de la policía.

Of course, it is important that this percentage be lowered, although it goes without saying that we are talking, supposedly, about the effectiveness of the preventive and repressive actions of the police.

Y está claro que si bien es cierto que ella es necesaria, no permite, por si sola, la teoría que se den los pasos necesarios para acortar el tiempo que puede insumir, aquí y en cualquier parte, derrotar a la aludida degradación social.

And it is clear that while it is true that it is necessary, theory alone does not allow the necessary steps to be taken to shorten the time it can take, here and anywhere, to defeat the aforementioned social degradation.

Pero hoy, para continuar la reflexión, no discurriré por el resto de ámbitos y cuestiones que, en la lucha por una convivencia más sana, deberían ser anteriores o al menos en paralelo con el descenso de los delitos, y que anidan en políticas educativas, culturales y económicas todavía imperfectas.

But today, to continue the reflection, I will not go through the other areas and issues that, in the fight for a healthier coexistence, should be prior to or at least in parallel with the decrease in crimes, and that nest in educational policies, cultural and economic still imperfect.

En cambio, me quedo a pensar en ese mundo del delito que, más allá de estadísticas con referencias demasiado recientes para la comparación, es hoy un pulpo de más tentáculos que aquel que cualquier comunidad como ésta conoció décadas atrás, desde su habitante más viejo y lúcido como para analizar estas cuestiones.

Instead, I am left to think about that world of crime that, beyond statistics with too recent references for comparison, is today an octopus with more tentacles than the one that any community like this knew decades ago, from its oldest and oldest inhabitant. lucid enough to analyze these questions.

Por ejemplo: cantidad de presos, cantidad de cárceles y su estado, y régimen de distribución en ellas de los castigados por la ley penal.

For example: number of prisoners, number of prisons and their status, and distribution regime in them of those punished by criminal law.

Se dice que Uruguay ha batido su record histórico de cantidad de encarcelados, que lo acerca a los peores porcentajes expuestos por otras naciones que, en tal aspecto, van a la cabeza en el planeta.

It is said that Uruguay has beaten its historical record for the number of incarcerated, which brings it closer to the worst percentages exhibited by other nations that, in this regard, lead the world.

¡Claro que es un problema! Sin embargo, me siento muy alejado de esa idea que algunos manejan, para resolver el problema, de aumentar las medidas sustitutivas del encarcelamiento que ya existen –e incluso han crecido con la aplicación del Nuevo Código del Proceso Penal- porque sólo logran que menos gente que ha incursionado en el delito vaya a una celda, sin poner en la balanza el riesgo, que admito tiene sus excepciones, de dejarla en la calle convertida cuanto menos en un peligro potencial.

Of course it is a problem! However, I feel very far from that idea that some manage, to solve the problem, of increasing the alternative measures for incarceration that already exist – and they have even grown with the application of the New Code of Criminal Procedure – because they only achieve that fewer people who has incurred in the crime go to a cell, without weighing the risk, which I admit has its exceptions, of leaving it on the street converted at least into a potential danger.

Lo principal está en otra parte: las cárceles de este país, salvo algún caso aislado que no alcanza a disimular la realidad, son obsoletas, están en un estado de deterioro espantoso y, como han crecido al paso de los recientes años las personas que son enviadas a ellas, exhiben un hacinamiento inadmisible que las transforma en focos de violencia interna y escuelas de primer nivel para delincuentes inexpertos o apenas primarios, que cuando salen en libertad lo hacen portando un diploma que nadie, pero nadie  debería querer.   

The main thing is elsewhere: the prisons of this country, except for an isolated case that fails to disguise reality, are obsolete, are in a state of appalling deterioration and, as the people who are sent to them, they exhibit an unacceptable overcrowding that transforms them into centers of internal violence and first-rate schools for inexperienced or barely elementary criminals, who when they are released they do so carrying a diploma that no one, but no one should want.

Entonces, aparecen dos necesidades a las que hay que mirar de frente y no darle vuelta la cara como si estuviésemos hablando de la posible vida extraterrestre.

Then, two needs appear that you have to look at in the face and not turn your face as if we were talking about possible extraterrestrial life.

Primero, hay que construir más cárceles, de tal modo que se termine con el hacinamiento y la vida infrahumana que hoy se soporta en las que funcionan. Porque una cosa es la necesidad de encarcelar a quien viola la ley, y la Justicia lo castiga con apego a ella, y otra muy distinta añadir a la vida de los presos un castigo infernal e inaceptable. Es obvio que deben ser establecimientos no tan absurdamente monumentales como el Comcar o el penal de Libertad, ni tan pequeños, adaptados en penosos edificios, como abundan en muchas ciudades del interior del país. Y no creo que la dificultad pase por las características de las cárceles modernas, ya que se conocen de sobra. Pasa por cómo se las financia, en época de economía cercada. Bueno, habrá que ingeniarse; ahí sí se puede echar mano de los fideicomisos o aquellos abandonados planes de construcción con financiación pública y privada.

First, we must build more prisons, in such a way as to end the overcrowding and the subhuman life that today is supported in those that operate. Because one thing is the need to imprison those who violate the law, and Justice punishes him with adherence to it, and quite another to add an infernal and unacceptable punishment to the lives of the prisoners. It is obvious that they must be establishments not so absurdly monumental like the Comcar or the Libertad prison, nor so small, adapted into painful buildings, as they abound in many cities in the interior of the country. And I do not think that the difficulty is due to the characteristics of modern prisons, since they are well known. It goes through how they are financed, in times of a closed economy. Well, it will be necessary to manage; there you can use trusts or those abandoned construction plans with public and private financing.

Segundo, sea a través de quien sea -el magistrado judicial que dicta la sentencia o el Instituto Nacional de Cárceles, dependiente del Ministerio del Interior- se deberá entender que no se puede hacer entre delincuentes experimentados, violadores, narcotraficantes y primarios un puchero a la española porque, ahí sí, se están arrimando fósforos a un paquete explosivo que puede hacer saltar todo por los aires en cualquier momento. ¡Déjense de tontear con las mezclas de ocasión, porque no hay lugares disponibles o porque, sencillamente, no se presta debida atención a cada caso!

Second, whether through whoever it is – the judicial magistrate who dictates the sentence or the National Institute of Prisons, dependent on the Ministry of the Interior – it should be understood that a pout cannot be made between experienced criminals, rapists, drug traffickers and primaries. Spanish because, there yes, matches are being brought close to an explosive package that can blow everything up at any moment. Stop fooling around with second-hand mixes, because there are no places available or because there is simply not enough attention to each case!

Tercero, y esencial, esas nuevas cárceles, primero por una más inteligente y defensiva distribución de los presos, ha de permitir, a aquellos que son recuperables, acceder a políticas de estudio, de trabajo y de deportes que contribuyan a su rehabilitación, y que deberán estar a cargo de suficientes y preparados profesionales en cada tema.

Third, and essential, these new prisons, first for a more intelligent and defensive distribution of the prisoners, must allow those who are recoverable, access to study, work and sports policies that contribute to their rehabilitation, and that They must be in charge of sufficient and trained professionals in each subject.

Algo más, como en botica: hay que cambiar el NCPP porque es bochornoso; el Poder Judicial debe ser más ágil en sus decisiones; y la Justicia debe ser independiente también económicamente, para serlo de forma integral.

Something else, as in a pharmacy: you have to change the NCPP because it is embarrassing; the Judicial Power must be more agile in its decisions; and Justice must also be financially independent, to be so in a comprehensive manner.

Leo todo lo escrito y entiendo dos cosas que destellan como un letrero luminoso: una política de Estado al respecto, todavía ausente, y la aplicación de fondos para que la idea sea tangible.

I read everything that has been written and I understand two things that flash like a luminous sign: a State policy in this regard, still absent, and the application of funds to make the idea tangible.

No hay atajos a estos primeros pasos. Por eso lo inicial es el consenso, el abandono del dogmatismo político para lograrlo, y un proceso que no será fácil e implicará bastante tiempo, para que aparezcan los planos y el dinero.

There are no shortcuts to these first steps. That is why the initial thing is the consensus, the abandonment of political dogmatism to achieve it, and a process that will not be easy and will involve enough time for the plans and money to appear.
