THE THINKER: SPACES AND ACTIVITIES

En un contexto de desbordada politización, con tufo a campaña pre-electoral adelantada a empellones, el oficialismo y la oposición están incrementando un debate que, cual parabrisas de automóvil moderno, va tal vez demasiado rápido de un lado a otro del parabrisas que pretende ayudar a la vista a observar el camino, pero en este caso haciéndole un mal favor a la inteligibilidad de los argumentos. Estos pasan, a excesiva velocidad, de lo inteligente o razonable al sonsonete incómodo de las frases hechas por dogmas que caminan por ahí cual arcaicos fantasmas.

In a context of overwhelmed politicization,with the smell of a pre-electoral campaign pushed forward, the ruling party and the opposition are increasing a debate that, like the windshield of a modern car, it is perhaps going too fast from one side of the windshield to the other which is intended to help the eye to observe the road, but in this case doing a bad favor to the intelligibility of the arguments. These pass, at excessive speed, from the intelligent or reasonable to the uncomfortable sing-song of the phrases made by dogmas that walk around like archaic ghosts.

Bien: ese debate involucra a la violencia, la cantidad de delitos cometidos, el hacinamiento de las cárceles y los cuasi inexistentes programas de rehabilitación, añadiéndose el supuesto agravamiento que en todo ese proceso implicaría la Ley de Urgente Consideración, gran parte de la cual se pretende derogar en un próximo referéndum.

Well: that debate involves violence, the amount of crimes committed, the overcrowding of prisons and the almost non-existent rehabilitation programs, adding the supposed aggravation that the Urgent Consideration Law would imply throughout this process, a large part of which is to be repealed in a future referendum.

Me alejaré lo posible de cuanta tontería se está propalando de un lado u otro al respecto, para expresar, apoyándome como siempre en el libre pensamiento crítico con la ética del postulado, una opinión personal sobre la cual admito cualquier disidencia siempre que sea con respeto y tolerancia.

I will stay away as much as possible from how much nonsense is spreading from one side or another about it, to express, relying as always on free critical thought with the ethics of the postulate, a personal opinion on which I admit any dissent as long as it is with respect and tolerance.

Pelearse en unos arrebatos ridículos acerca de cifras de delitos al paso de los últimos años se me hace algo patético, siendo que cualquier ciudadano puede comprobar, como víctima u observándolos por casualidad o contra su voluntad, que son moneda corriente en cualquier barrio de la capital y ciudades importantes del interior, e incluso en pueblos de la campaña. Peor aún: cualquier ciudadano puede comprobar, sin atisbo de duda, que la violencia de los delitos, en términos generales, es problema mayor que el carácter de esos delitos. Concluyendo, diría que, porcentajes más hacia aquí o más hacia allá, hay entre nosotros una patología que va cercando la pretensión de recuperar una sociedad educada, tolerante, respetuosa y con tendencia a la benevolencia.

Fighting in some ridiculous outbursts about crime figures over the past few years seems pathetic to me, being that any citizen can verify, as a victim or observing them by chance or against their will, which are commonplace in any neighborhood of the capital and major cities in the interior, and even in campaign towns. Worse still: any citizen can verify, without a hint of doubt, that the violence of crimes, in general terms, is a bigger problem than the nature of those crimes. In conclusion, I would say that, percentages more towards here or there, there is a pathology among us that is closing in on the pretense of recovering an educated, tolerant, respectful society and with a tendency to benevolence.

También me suena patética la insistencia de muchos sobre que el hacinamiento carcelario ha cobrado un porte escandaloso por la mayor cantidad de procesamientos que concluyen en el aumento de presos. Es que nadie puede negar ese hacinamiento porque las cárceles son insuficientes y la cuestión no se arregla dejando libre delincuentes o apelando a penas sustitutivas cuyo cumplimiento luego no se vigila, del mismo modo que nadie negará que las autoridades competentes –se ha hablado de un organismo paralelo que cumple tal función, cuando a mi juicio deberían ser los magistrados previo un pormenorizado estudio de las personalidades que remiten a las celdas- suelen entreverar penados primarios con presos grado cinco, contribuyendo a trabar más las lentísimas ruedas que mueven el carro de los enunciados procesos de rehabilitación.

The insistence of many that prison overcrowding has become scandalous due to the greater number of prosecutions that have resulted in an increase in prisoners also sounds pathetic to me. It is that nobody can deny that overcrowding because the prisons are insufficient and the issue is not settled by releasing criminals or by appealing to alternative penalties whose compliance is not monitored later, in the same way that nobody will deny that the competent authorities -There has been talk of a parallel body that fulfills this function, when in my opinion it should be the magistrates after a detailed study of the personalities that refer to the cells- They tend to entail primary convicts with grade five prisoners, contributing to further hinder the very slow wheels that move the cart of the aforementioned rehabilitation processes.

Finalmente, está la organización interna de las cárceles y las responsabilidades emergentes de quienes son designados para manejarlas. Es de una claridad enceguecedora que, desde tiempo ha, no se elige a esas personas con los cuidados y garantías indispensables, mientras se toma el recreo de la distracción frente a los múltiples casos de corrupción policial que ocurren aunque mal se disimulen. No es por otro camino que los “profesionales” del delito manejan organizaciones criminales desde su encarcelamiento, usan y cambian celulares cuando quieren, organizan “grupos de acción” internos para mantener o disputar el poder con otras bandas,

Pues bien: aunque a muchos les suene dramático o poco razonable, la primer medida es construir más cárceles, de condiciones adecuadas en tamaño y estructura que respeten los derechos de los reclusos –que los tienen, aun en su condena-, para cortar de cuajo el hacinamiento. La segunda medida es devolver a los magistrados, obligándolos a hacer los estudios profesionales de cada condenado a los que me referí antes, la responsabilidad de adónde enviarlos, evitando la actual y muy perniciosa “olla podrida”, reina del entrevero que convierte las cárceles en antros de perfeccionamiento de delincuentes cada día más avezados y más crueles, que se ha creado durante décadas.

La tercera, y en una simplificación en la que caigo por razones de espacio, es crear, tomándose en serio la tarea, esos programas de rehabilitación con los que tantos hacen gárgaras cínicas. Para rehabilitar, es obvio que, primero, los presos deben estar separados y organizados en dos grupos: los que pueden ser realmente recuperados y los que, hasta científicamente, está probado que no. A los eventuales beneficiarios hay que mantenerlos menos en las celdas y más ocupados en actividades que les atraigan, sean necesarias o, aunque sólo sea eso, los entretengan, mientras, claro, el entretenimiento –deportes, juegos de mesa, lecturas, concursos de actividades diversas, aprendizaje de oficios, etcétera- esté instrumentado sin fisuras para bajar su ansiedad, impulsar su quizás dormida benevolencia y captar su atención en primer lugar, y para generarles después, una vez liberados, posibilidades de regresar a la libertad con mínimas pero firmes posibilidades de reinserción en una vida social normal.

No soy ingenuo. Sé que, por la maldita forma generalizada que tenemos de hacer política en tiempos donde el enfrentamiento paga, todavía no se ha logrado crear en torno a esto, como en torno también a la educación o al fomento de las cooperativas, o al beneficio constructivo de familias que necesitan de una vivienda digna, verdaderas políticas de Estado.

I am not naive. I know that, due to the damn generalized way that we have to do politics in times where confrontation pays, it has not yet been possible to create around this, as well as around education or the promotion of cooperatives, or the constructive benefit of families that need decent housing, true State policies.

Osea de ésas que, una vez aprobadas por una mayoría parlamentaria, no pueden ser cambiadas según el arbitrio de quienes pasen a ocupar el poder en el próximo gobierno de turno.

That is, one of those that, once approved by a parliamentary majority, cannot be changed according to the discretion of those who come to power in the next government of the day.

Como otras veces, he escrito esto con la única aspiración de incitar a la reflexión colectiva. Ya veremos qué pasa.
