THE THINKER: THE FACTORY

Cada día que pasa se hace más firme mi convencimiento de que, como sociedad, vamos camino de convertirnos en una fábrica de desaguisados con consecuencias de creciente gravedad porque parece que todas las referencias orientadoras, históricamente incorporados a ella, han entrado en estado de dilución u oscurantismo.

With each passing day, my conviction that, as a society, we are on the way to becoming a factory of messes with increasingly serious consequences because it seems that all the guiding references, historically incorporated into it, they have entered a state of dilution or obscurantism.

Veamos el penúltimo ejemplo.

Let’s look at the penultimate example.

Cualquier ciudadano sabe que la historia clínica de un paciente que ha sido analizado o intervenido por un médico, le pertenece a ese paciente.

Any citizen knows that the clinical history of a patient who has been analyzed or intervened by a doctor belongs to that patient.

Sin embargo, frente a normas tan claras a veces se alzan inconvenientes prácticos.

However, in the face of such clear rules, practical drawbacks sometimes arise.

Analicemos esta situación: el paciente en cuestión es una persona detenida por la policía y encarcelada de forma preventiva, ya sea en averiguación de antecedentes o como indagado y hasta imputado de algún delito. Nadie ignora –salvo que se ponga el manto de la hipocresía sobre sus hombros- que últimamente se han multiplicado las denuncias de malos tratos a esos ciudadanos por parte de los funcionarios policiales actuantes. De acuerdo a la legislación vigente, el detenido tiene derecho a que su estado físico y hasta sicológico sean revisados por un médico especializado que deberá producir su informe como parte de su responsabilidad profesional y dirimir el asunto con la fiscalía donde cayó el caso.

Let’s analyze this situation: the patient in question is a person detained by the police and imprisoned preventively, either in background check or as investigated and even charged with a crime. No one ignores – unless the cloak of hypocrisy is put on their shoulders – that reports of mistreatment of these citizens by the acting police officers have multiplied lately. According to current legislation, the detainee has the right to have his physical and even psychological condition reviewed by a specialized doctor who must produce his report as part of his professional responsibility and settle the matter with the prosecutor’s office where the case fell.

Este proceso venía llevándose a cabo desde hace décadas de modo más o menos preciso desde el punto de vista de la revisación y siguiendo un camino, hay que decirlo, bastante intrincado hasta llegar, como debe hacerlo, y lo más pronto posible, a manos del fiscal o juez actuante. En algún detalle menor el Nuevo Código del Proceso Penal procuró mejorar estas circunstancias y, hasta ahora, si bien las denuncias de maltrato continuaron, el mecanismo pareció adquirir más solidez.

This process had been carried out for decades in a more or less precise way from the point of view of revision and following a path, it must be said, quite intricate until it arrives, as it should, and as soon as possible, at the hands of the acting prosecutor or judge. In some minor detail, the New Code of Criminal Procedure sought to improve these circumstances and, until now, although the complaints of mistreatment continued, the mechanism seemed to acquire more solidity.

Autoridades de ASSE –que es decir de Salud Pública-, responsables de esas revisaciones médicas, hicieron saber a los abogados defensores y a los magistrados, que el único propietario del informe producido –por decirlo de un modo claro- es el mismísimo paciente.

ASSE authorities -which is to say Public Health-, those responsible for these medical examinations informed the defense attorneys and the magistrates that the sole owner of the report produced – to put it bluntly – is the patient himself.

¿Parece un inconveniente menor?

Does it seem like a minor inconvenience?

Pues no lo es. El paciente es un detenido. La policía, incluso la eventualmente responsable de algún mal trato, de no haber otra posibilidad, será la que reciba el diagnóstico y lo comunique al juzgado actuante, dejando campo abierto a todo tipo de especulaciones; esto es así en los crudos hechos porque aunque el representante legal es el abogado defensor, parece que la única forma que admitiría ASSE de que éste –que es lo mismo que decir el paciente o el detenido- se informe al instante, como es debido, sería que estuviera presente durante la revisación de su estado físico y mental.

Well it isn’t. The patient is a detainee. The police, even those eventually responsible for some mistreatment, if there is no other possibility, will be the ones to receive the diagnosis and communicate it to the acting court, leaving the field open to all kinds of speculation; this is so in the crude facts because although the legal representative is the defense attorney, it seems that the only way that ASSE would admit that this -which is the same as saying the patient or the detainee- is informed instantly, as it should be, it would be for him to be present during the review of his physical and mental condition.

What is the problem?, you may ask, reader.

Vayamos al de mayor tamaño: la Asociación de Defensores de Oficio, que representa a una importante mayoría de detenidos, carece del personal suficiente para cumplir con ese mecanismo.

Let’s go to the largest one: the Public Defenders Association, which represents a significant majority of detainees, lacks sufficient personnel to comply with this mechanism.

¡Es tan tonto todo esto! Bastaría que el médico certificante entregase al abogado en cuestión el informe y santo remedio. O que se lo trasladase de inmediato al magistrado para que éste, sin demora, diera cuenta al letrado de los resultados y la apertura de eventuales consecuencias que, es obvio, podrían llegar a incidir en el proceso.

This is all so silly! It would be enough for the certifying doctor to deliver the report and holy remedy to the lawyer in question. Or that it be transferred immediately to the magistrate so that he, without delay, informs the lawyer of the results and the opening of possible consequences that, obviously, could affect the process.

Pero, hasta donde ha trascendido hasta ahora, ASSE no acepta tal procedimiento y se ampara en las normas que respaldan esa afirmación de que “la historia clínica es del paciente y de nadie más”. En realidad, semeja una poco imaginativa forma de “sacar la pata del lazo” para no involucrarse en hipotéticas circunstancias posteriores. No lo afirmo, digo que parece eso.

But, as far as it has transpired so far, ASSE does not accept such a procedure and relies on the regulations that support that statement that «the medical record belongs to the patient and no one else.» In reality, it seems like an unimaginative way of «getting the leg out of the loop» so as not to get involved in hypothetical later circumstances. I’m not saying it, I’m saying it looks like that.

Como este asunto bulle hoy desbordando la olla, repleta de ingredientes, y nadie sabe qué ocurrirá luego de haber escrito yo esto o mañana o pasado mañana, voy a dejar la cuestión por acá, dándome por satisfecho con haber incitado a algunos ciudadanos a reflexionar al respecto.

As this topic is boiling today, the pot overflowing, full of ingredients, and no one knows what will happen after I have written this or tomorrow or the day after tomorrow, I am going to leave the topic here, satisfied that I have prompted some citizens to reflect on the I respect.

Ocurre, no obstante, que esto es apenas una muestra de un montón creciente e inquietante de enredos al santo cohete que están ocurriendo en nuestra sociedad.

It so happens, however, that this is just one sample of a growing and disturbing lot of messes to the holy rocket that are happening in our society.

Hasta he pensado, como otros contribuyentes aseguran, que la pandemia ha pegado muy fuerte en la estabilidad intelectual de más gente de la prevista. Y no quiero que esto se lea como una humorada, una ironía o un sarcasmo. Hay que tenerlo en cuenta.

I have even thought, as other contributors assure, that the pandemic has hit very hard on the intellectual stability of more people than expected. And I don’t want this to read as humor, irony, or sarcasm. You have to consider this.

De otra manera, tendríamos que pensar que la incapacidad de demasiados legisladores, las marchas y contramarchas en el Poder Ejecutivo y el puchero a la española en que se ha convertido la justicia, empezando por la Suprema Corte, siguiendo por los fiscales, los abogados defensores y los propios abogados privados colegiados, son síntomas propios de una degradación en la que viene cayendo esta democracia republicana desde hace demasiado tiempo y sin que se sepa bien por qué.

Otherwise, we would have to think that the incapacity of too many legislators, the marches and countermarches in the Executive Power and the Spanish-style stew that justice has become, beginning with the Supreme Court, followed by the prosecutors, the defense attorneys and the private collegiate lawyers themselves, are symptoms of a degradation in which this republican democracy has been falling for too long and without knowing why.
