THE THINKER: AH, JUSTICE

Hay problemas en la sociedad uruguaya, diagnosticados desde hace décadas, que, lejos de resolverse se hacen más complejos e inconvenientes. Quizás, al menos en parte, son expandidos por la complejidad acelerada de la vida cotidiana. Esa que imponen los avances veloces de problemas causados hasta por actividades importantes –e intrínsecamente constructivas- como la ciencia, la tecnología y la educación, además de otras, éstas patológicas, como la previsión social en un país que ve envejecer su población más que otros y donde la debilidad en la lucha contra el delito y la corrupción pierden terreno, por ahora sin remedio.

There are problems in Uruguayan society, diagnosed decades ago, which, far from being resolved, become more complex and inconvenient. Perhaps, at least in part, they are expanded by the accelerated complexity of everyday life. That imposed by the rapid progress of problems caused even by important activities -and intrinsically constructive- such as science, technology and education, in addition to others, these pathological, such as social security in a country that sees its population age more than others and where the weakness in the fight against crime and corruption is losing ground, for now without remedy.

Por hoy me ocuparé del Poder Judicial, cimiento o equilibrio indispensable de un sistema de gobierno democrático republicano como el que aún nos enorgullece.

For today I will deal with the Judiciary, foundation or indispensable balance of a system of republican democratic government like the one that still makes us proud.

Enfrenta dos obstáculos que deberían ser removidos.

He faces two obstacles that should be removed.

Uno de ellos, al que me he referido antes, es la independencia, esencial para el ejercicio pleno de la justicia pues incide en aspectos humanos y materiales que pueden causar la aparición de complicaciones: ninguna interferencia del Poder Ejecutivo ni del Parlamento, salvo lo establecido en la Constitución, personal suficiente y bien formado, estructura edilicia adecuada a las necesidades reales y actualización técnica permanente.

One of them, to which I have referred before, is independence, essential for the full exercise of justice since it affects human and material aspects that can cause the appearance of complications: no interference from the Executive Power or Parliament, except as established in the Constitution, sufficient and well-trained personnel, a building structure adequate to real needs and permanent technical updating.

Pues bien, una vez más sostendré la hipótesis de que el Poder Judicial carece de esa imprescindible independencia: Se trata de lo presupuestal: depende no de un presupuesto armado por la Suprema Corte con el apoyo técnico y profesional indispensable, sino de lo que el Ejecutivo, a través del Ministerio de Economía y previo paso decisivo por el Poder Legislativo, decida otorgarle. Esto está mal y no voy a hartar al lector con argumentos al respecto pues ya los he expuestos y creo que se entienden claramente, así como sus consecuencias.

Well, once again I will support the hypothesis that the Judiciary lacks that essential independence: It is about the budget: it depends not on a budget put together by the Supreme Court with the indispensable technical and professional support, but on what the Executive , through the Ministry of Economy and after a decisive step by the Legislative Power, decide to grant it. This is wrong and I am not going to tire the reader with arguments about it because I have already exposed them and I think they are clearly understood, as well as their consequences.

¿Si este nudo lleva tanto tiempo atado y hasta ahora sigue apretando sin medida, por qué hoy se debería hacer un nuevo intento liberador? Por lo dicho al comienzo: la sociedad y su cotidianidad son cada día más complejas y exigen, también del Poder Judicial, recursos que permitan su actividad constitucional sin el peaje de tantas desgastantes y riesgosas negociaciones con la política, al cabo de las cuales siempre quedará algo por el camino. Y habrá consecuencias poco estimulantes.

If this knot has been tied for so long and until now continues to tighten without measure, why should a new liberating attempt be made today? For what was said at the beginning: society and its daily life are more complex every day and require, also from the Judiciary, resources that allow its constitutional activity without the toll of so many exhausting and risky negotiations with politics, after which there will always be something on the way. And there will be uninspiring consequences.

Adosado va el sacudido y tampoco resuelto asunto de a quién responde, a fin de cuentas, la Fiscalía de la Nación. Así como los problemas apuran y empujan, así se apuran y empujan unos y otros en las propuestas de solución. Unos esfuerzos que, vistos con la mayor honestidad intelectual posible, sólo pueden convocar a más disensos y debates mientras el ciudadano común no tiene la más remota idea de qué está pasando en ese ámbito, que semeja algo extraído de la realidad terrenal. ¿Mantenemos la Fiscalía en manos de un solo funcionario? ¿Creamos una trilogía de fiscales para tomar el mando? En cualquier caso, y al margen de esa manida y tan prostituida frase de “la independencia técnica”, ¿cuál terminaría siendo, en los hechos, la relación con la Suprema Corte, el Parlamento y el Ejecutivo?

Some efforts that, seen with the greatest possible intellectual honesty, can only call for more dissent and debate while the common citizen does not have the remotest idea of ​​what is happening in that area, which seems like something extracted from earthly reality. Do we keep the Prosecutor’s Office in the hands of a single official? Did we create a trilogy of prosecutors to take charge? In any case, and aside from that hackneyed and prostituted phrase of «technical independence», what would end up being, in fact, the relationship with the Supreme Court, Parliament and the Executive?

Finalmente, queda una cuestión: no es más pequeña sino que se pierde con facilidad en la oscuridad de la ignorancia de los contribuyentes.

Finally, one issue remains: it is not smaller but is easily lost in the obscurity of taxpayers’ ignorance.

Se trata de los casos de irregularidades administrativas –o más graves, porque implican sanciones a seres humanos con sus derechos a cuestas- en los procesos judiciales, que implican a fiscales y jueces, y en algunos casos en reiteración real.

These are cases of administrative irregularities – or more serious, because they imply sanctions to human beings with their rights in tow – in judicial processes, which involve prosecutors and judges, and in some cases in real reiteration.

Del Poder Judicial sale poca o ninguna información oficial. Depende de cada caso. ¿Hasta dónde llega la falta comprobada de un fiscal o de un juez? ¿Cuánto tiempo insume un sumario administrativo, o quizás una sanción directa y más grave? Es decir, por ejemplo, ¿cuánto debe esperar un imputado en que se corrija lo que le ha afectado por defección de una sede judicial, o un condenado para que se haga efectivo su castigo, superadas con la verdad todas las instancias previstas en los códigos vigentes?

Little or no official information comes out of the Judiciary. It depends on each case. How far does the proven lack of a prosecutor or a judge go? How much time does an administrative summary take, or perhaps a direct and more serious sanction? That is to say, for example, how long must a defendant wait for what has affected him to be corrected due to the defection of a judicial seat, or a convicted person for his punishment to be carried out, once all the instances provided for in the codes have been overcome with the truth? in force?

Mientras se espera que quien debe hacerlo en primer lugar se exprese, con todos los detalles que la ciudadanía merece saber, crecen a través de los medios y las redes sociales multitud de versiones, incluso novelescas, creando un ánimo de incomodidad e indignación en las personas comunes.

While it is expected that the person who should do it in the first place expresses himself, with all the details that citizens deserve to know, a multitude of versions, even fictional ones, are growing through the media and social networks, creating a mood of discomfort and indignation in people. common.

Para cerrar, otra interrogante: ¿qué fue de la vida y obra del vocero oficial de la Suprema Corte que, durante años, cumplió –a veces con exceso de formalidad que dejaba dudas en pie, pero algo era algo- una tarea para el acercamiento de la gente a lo que iba ocurriendo en realidad y, en ciertos casos, una suerte de  docencia?

To close, another question: what happened to the life and work of the official spokesman for the Supreme Court who, for years, fulfilled -sometimes with excessive formality that left doubts standing, but something was something- a task for the rapprochement of the people to what was actually happening and, in certain cases, a kind of teaching?

La política debería bajarse del corcel encabritado y, junto a los magistrados, iniciar un acercamiento que disuelva todo esto, a riesgo que, de encapricharse, el daño alcance una estatura monstruosa.

Politics should get off the rearing steed and, together with the magistrates, start an approach that dissolves all this, at the risk that, if they take a fancy, the damage reaches a monstrous stature.
