THE THINKER: THE SLOWNESS

Cuando Milan Kundera publicó “La lentitud”, en 1995, confesó que “escribió por fin lo que siempre había deseado, una gran tontería por puro gusto”.

When Milan Kundera published «The slowness» in 1995, he confessed that «he finally wrote what he had always wanted, a great nonsense for pure pleasure.»

Todos sabemos que Kundera ha sido un gran cultor de la ironía en cierto modo prepotente, provocadora; sin embargo, en el capítulo inicial de esa novela breve se pregunta por qué habrá desaparecido el placer de la lentitud, antagónico a la velocidad  que la revolución técnica ha brindado al hombre. Y añade: “Un proverbio checo define la dulce ociosidad mediante una metáfora: contemplar las ventanas de Dios”.

We all know that Kundera has been a great worshiper of irony in a certain arrogant, provocative way; however, in the opening chapter of that short novel he wonders why the pleasure of slowness, antagonistic to the speed that the technical revolution has given man, has disappeared. And he adds: “A Czech proverb defines sweet idleness through a metaphor: to contemplate the windows of God”.

Confieso que para mí, pensando en la cuestión que pienso desarrollar, esta referencia es sencillamente, sí, metafórica, donde no se oculta la ironía, a veces mero sarcasmo, de Kundera, pero, sea como fuere y a mi juicio, la contradicen aspectos de la realidad que vivimos.

I confess that for me, thinking about the question that I intend to develop, this reference is simply, yes, metaphorical, where Kundera’s irony, sometimes mere sarcasm, is not hidden, but, in any case and in my opinion, it is contradicted by aspects of the reality we live.

¿Por qué? Bueno, quizás porque quiero empujar al lector a la reflexión acerca de la lentitud de la justicia uruguaya, “dulce ociosidad” al decir de Kundera, a la que para nada considero útil y sí carente de sentido común y responsabilidad profesional.

Why? Well, perhaps because I want to push the reader to reflect on the slow pace of Uruguayan justice, «sweet idleness» as Kundera put it, which I do not consider useful at all and lacking in common sense and professional responsibility.

Hay un fiscal en lo penal que por estas horas está trabajando mucho con adversidades y problemas graves derivados de las furiosas pasiones que, día a día, crecen entre las llamadas “barras bravas” de los clásicos rivales futbolísticos Peñarol y Nacional.

There is a criminal prosecutor who at this time is working hard with adversities and serious problems derived from the furious passions that, day by day, grow between the so-called «barras bravas» of the classic soccer rivals Peñarol and Nacional.

Dejaré de lado esa investigación y los actos jurídicos aplicados o pendientes por delitos gravísimos ya ocurridos, pues el lector cuenta sobre al respecto con amplia información.

I will leave aside that investigation and the legal acts applied or pending for very serious crimes that have already occurred, since the reader has extensive information about it.

Por hoy, prefiero debatir en torno a la lentitud de una fiscalía de turno a cuyo responsable no conozco ni por su nombre.

For today, I prefer to discuss the slowness of a prosecutor’s office on duty whose manager I do not even know by name.

Apenas se supo que dos partidos absurdamente llamados “amistosos” entre esos rivales, considerados por el Ministerio del Interior como de alta peligrosidad y riesgo social, con sugerencia firme de suspensión, y la Asociación Uruguaya de Fútbol, única entidad privada legalmente autorizada a realizarlos que decidió acompañar la recomendación policial, dicha fiscalía, que supongo pudo actuar de oficio, no prestó atención a tales hechos.

It was hardly known that two games absurdly called «friendly» between those rivals, considered by the Ministry of the Interior as highly dangerous and socially risky, with a firm suggestion of suspension, and the Uruguayan Football Association, the only private entity legally authorized to carry them out, which decided to follow the police recommendation, said prosecutor’s office, which I suppose could have acted ex officio , did not pay attention to such facts.

Los espectáculos igual se montaron y el primer encuentro ya dejó paño para la preocupación, con cánticos de las hinchadas que convocaron a ritos mortuorios, más allá de la inesperada suspensión, sobre el final, por una fortísima tormenta eléctrica acompañada de una lluvia torrencial.

The shows were still staged and the first meeting already left room for concern, with songs from the fans who called for mortuary rites, beyond the unexpected suspension, towards the end, due to a very strong electrical storm accompanied by torrential rain.

¿Qué pasó? La empresa privada que tiene los derechos televisivos sobre estos partidos, sosteniéndose en un inadmisible argumento basado en el contrato firmado para su realización, asumió sin más hacerse cargo de la organización pero echó la responsabilidad de que “no pasaría nada”, con la AUF y el gobierno haciendo mutis por el foro, sobre los hombros del Ministerio del Interior. Y aquí aparece otra interrogante que quema: ¿El Ministerio, una institución del Estado, dio marcha atrás y aceptó por sí la responsabilidad por presión de esa empresa? ¿O consultó a la Presidencia de la República?

What happened? The private company that has the television rights to these matches, holding on to an inadmissible argument based on the contract signed for its realization, without further ado took charge of the organization but took the responsibility that «nothing would happen», with the AUF and the government leaving the forum, on the shoulders of the Ministry of the Interior. And here another burning question appears: Did the Ministry, a State institution, backtrack and accept responsibility by itself due to pressure from that company? Or did you consult the Presidency of the Republic?

No soy abogado, mucho menos constitucionalista, pero algo he leído al respecto y, además, tengo encima más de sesenta años de periodista lidiando con asuntos similares. No creo que exista –aunque siempre admitiré estar errado, si se prueba- ley alguna que sostenga este disparate, aclarando que estoy hablando de espectáculos donde concurre público, miles de personas, frente a las cuales el Estado no puede ignorar u olvidar momentáneamente sus deberes constitucionales; no son partidos de barrio, amistosos entre solteros y casados, fútbol de pibes que se juntan en un campito y se divierten.

I am not a lawyer, much less a constitutionalist, but I have read something about it and, furthermore, I have more than sixty years of experience as a journalist dealing with similar issues. I do not believe that there is – although I will always admit to being wrong, if it is proven – any law that supports this nonsense, clarifying that I am talking about shows where the public attends, thousands of people, in front of whom the State cannot momentarily ignore or forget its duties constitutional; They are not neighborhood games, friendlies between singles and married couples, soccer for kids who get together in a small field and have fun.

Si yo tuviese razón, vuelve la pregunta: ¿un fiscal de turno no puede actuar de oficio y, a la luz de toda la información disponible, y detener el delirio? ¿Acaso vamos a declamar aquí también poéticas oraciones en defensa de la libertad por encima de las obligaciones de la entidad privada legalizada para calzarse la responsabilidad, la AUF, o, si esta no lo hace y sólo “saca el cuerpo”, las obligaciones inalienables del Estado?

If I were right, the question returns: Can’t a prosecutor on duty act ex officio and, in light of all the information available, stop the delusion? Are we perhaps going to recite poetic prayers here in defense of freedom over and above the obligations of the legalized private entity to shoulder responsibility, the AUF, or, if it does not do so and only «takes out the body», the inalienable obligations of the state?

¿El resultado? Se actúa después de ocurridos los hechos, si los hay. Porque… ¡mirá si nos preocupamos tanto, le quitamos a pasión a miles de uruguayos y al final no pasa nada!

The result? It acts after the events have occurred, if any. Because… see if we care so much, we take away the passion of thousands of Uruguayans and in the end nothing happens!

Me gustaría –qué digo, necesito saber si estoy equivocado o seguimos por el mal camino- que un señor fiscal, o un vocero de la Suprema Corte de Justicia, o quién diablos deba asumir el esclarecimiento ante la ciudadanía de lo ocurrido, diera la versión oficial.

I would like – what am I saying, I need to know if I am wrong or if we are continuing down the wrong path – that a prosecutor, or a spokesperson for the Supreme Court of Justice, or whoever the hell should be responsible for clarifying what happened to the citizens, would give the version official.

No porque yo pretenda tener razón, que, la verdad, preferiría no tenerla, sino para que no me gane la simpatía por esa metáfora de Kundera, donde la dulce ociosidad se justifica porque se ha preferido mirar las ventanas de Dios.   

Not because I pretend to be right, which, truthfully, I would prefer not to be, but so that I don’t gain sympathy for that metaphor of Kundera, where sweet idleness is justified because you have preferred to look at the windows of God.
