THE THINKER: THE FOUNDATION AT RISK

Una democracia republicana representativa es un sistema sostenido en la relación armónica y transparente de tres Poderes independientes: el Ejecutivo, el Legislativo y el Judicial, garante éste, en última instancia, de la estabilidad general.

A representative republican democracy is a system sustained by the harmonious and transparent relationship of three independent powers: the Executive, the Legislative and the Judicial, the latter guarantor, ultimately, of general stability.

No ignoro que se ha dicho que “la democracia es una forma de gobierno imperfecta, pero aun así, es la mejor”. Y creo tanto en la escueta pero precisa forma de expresión, como en el resultado final al que arriba la sociedad por ese camino, obviamente venciendo obstáculos por la simple e indiscutida razón de que toda organización política –la que construye Constitución, leyes, normas, relaciones entre los Poderes- son obra de seres humanos imperfectos.

I am not unaware that it has been said that “democracy is an imperfect form of government, but even so, it is the best.” And I believe both in the brief but precise form of expression, as well as in the final result that society arrives at along that path, obviously overcoming obstacles for the simple and undisputed reason that every political organization – the one that builds the Constitution, laws, norms, relations between the Powers – are the work of imperfect human beings.

Hoy, la comunidad nacional enfrenta una serie de sacudimientos, en algún caso inesperados, que afectan al Poder Judicial: desprolijidades del Nuevo Código del Proceso Penal, descoordinaciones entre fiscales –ahora a cargo de recibir e investigar las denuncias- y jueces, tribunales superiores y hasta, excepcionalmente, la propia Suprema Corte, última escala de cualquier hipotética decisión de un proceso.

Today, the national community faces a series of shocks, in some cases unexpected, that affect the Judiciary: inaccuracies in the New Code of Criminal Procedure, lack of coordination between prosecutors – now in charge of receiving and investigating complaints – and judges, superior courts and even, exceptionally, the Supreme Court itself, the last stopover for any hypothetical decision in a process.

Muchos factores se mezclan y dañan las mejores intenciones: formación despareja de magistrados, falta de personal en todas las áreas al menos del ámbito penal, exceso de trabajo en cada Fiscalía, inevitables reclamos salariales y notoria falta de la adecuada infraestructura, sobre todo para el tratamiento de los casos más complejos. El resultado está dejando un rosario de hechos que hay que resolver: jueces trasladados a otros ámbitos jurídicos como penalidad, jueces y fiscales sancionados administrativamente, magistrados suspendidos y sometidos a investigación, abogados litigantes o defensores que terminan en imputados y, para los ciudadanos víctimas de algunos delitos, interminables tramitaciones que, en ciertos casos, la mayoría, insumen años hasta su inapelable definición que no siempre alcanza el carácter de aceptabilidad de todas las partes.

Many factors mix and damage the best intentions: uneven training of magistrates, lack of personnel in all areas, at least in the criminal field, overwork in each Prosecutor’s Office, inevitable salary demands and a notable lack of adequate infrastructure, especially for the treatment of the most complex cases. The result is leaving a string of facts that must be resolved: judges transferred to other legal areas such as criminal law, judges and prosecutors administratively sanctioned, magistrates suspended and subjected to investigation, trial lawyers or defense attorneys who end up accused and, for citizens who are victims of some crimes, endless procedures that, in certain cases, the majority, take years until their final definition is not always acceptable to all parties.

Por ahora, reacciones ha habido. Y acusaciones de un lado a otro y viceversa y más debates poco comprensibles para los contribuyentes, mientras saltan, con mayor vigor y en mayor cantidad que décadas atrás, los actos expansivos y nefastos del narcotráfico –incluyendo huidas de líderes encarcelados con ayuda de funcionarios corruptos-, de asociaciones muy bien preparadas para facilitar desde “delitos de guante blanco” hasta la organización de ejércitos de jovencitos y hasta niños para robar, amenazar, tomar humildes viviendas por la fuerza en barrios marginales y asumir el repugnante y desconsolador papel de sicarios baratos.

For now, there have been reactions. And accusations from one side to the other and vice versa and more debates that are incomprehensible to taxpayers, while the expansive and disastrous acts of drug trafficking take place, with greater vigor and in greater numbers than decades ago – including the escape of imprisoned leaders with the help of corrupt officials. -, of associations very well prepared to facilitate everything from “white collar crimes” to the organization of armies of young people and even children to rob, threaten, take humble homes by force in marginal neighborhoods and assume the disgusting and heartbreaking role of cheap hitmen .

Se acercan los tiempos electorales y esta cuestión esencial está presente, incluso en los medios de comunicación, pero casi como “charlas de café”. Mientras tanto, algunas poderosas organizaciones sindicales, con apoyo político por ahora relativamente retaceado, organizan con prolijidad y persistencia medidas del tamaño de un plebiscito para resolver sus incomodidades con los proyectos ya aprobados en el Parlamento, del tipo de la Reforma de la Seguridad Social y la Reforma del Sistema Educativo, así como las propuestas de nueva legislación laboral que se ha anunciado.

Election times are approaching and this essential issue is present, even in the media, but almost like “coffee talks.” Meanwhile, some powerful union organizations, with political support for now relatively limited, organize with prolixity and persistence measures the size of a plebiscite to resolve their discomfort with the projects already approved in Parliament, such as the Social Security Reform and the Reform of the Educational System, as well as the proposals for new labor legislation that have been announced.

En una situación semejante, no queda otra que la mayoría de población decente, medianamente instruida y socialmente responsable, deje a un lado la quietud o la blasfemia desde un sillón contra la ventana y asuma su responsabilidad, que la tiene, sea cual fuere, en una legal actitud final, la decisión tomada sobre cada asunto.

In a similar situation, there is no choice but for the majority of the decent, moderately educated and socially responsible population to leave aside the stillness or the blasphemy from an armchair against the window and assume their responsibility, which they have, whatever it may be, in a final legal attitude, the decision taken on each matter.

Se vienen tiempos entreverados. No todos han mostrado sus cartas. Pero eso llegará y entontes, quizás, tendremos más claros los caminos que se abren –si es que esto ocurre- para ejercer nuestra responsabilidad, primero de votantes y luego de personas no preparas para aguantarnos lo que venga sino entrenadas para defender lo que sabemos que, aunque imperfecto, es mejor.   

Mixed times are coming. Not everyone has shown their cards. But that will come and then, perhaps, we will have clearer the paths that open up – if this happens – to exercise our responsibility, first as voters and then as people not prepared to put up with whatever comes but trained to defend what we know , although imperfect, is better.
