THE THINKER: ONCE UPON A GOOD TIME

Si se presta atención a todo lo que se dice del Poder Judicial –procurando, claro, analizarlo desde un punto de vista racional, lógico, de libertad de pensamiento crítico- sobran motivos para, cuanto menos, expresar preocupación. If attention is paid to everything that is said about the Judiciary – trying, of course, to analyze it from a rational and logical point of view, of freedom of critical thought – there are plenty of reasons to, at least, express concern.

El primer problema a la vista que enfrenta la Justicia, tomando en cuenta todas sus áreas de actividad pero principalmente los procesos penales, es la lentitud.

The first problem in sight facing the Justice, taking into account all its areas of activity but mainly criminal proceedings, is slowness.

En pasados días he escuchado protestas en torno a esa lentitud, en algún caso aislado relacionada con un supuesto desinterés, a decir verdad difícil de probar, expresadas por ciudadanos preocupados por decisiones que consideran urgentes y se dilatan en el tiempo acerca de actos de violencia contra mujeres, denuncias por discriminación de género, investigaciones sobre aspectos del narcotráfico y personas vinculadas, muertes de malvivientes sin aclarar y fugas de delincuentes al borde de lo inexplicable. Ah, y sigue estando a la vista de todos el ya extenuante proceso llamado “Operación océano”.

In the past few days I have heard protests about this slowness, in some isolated case related to an alleged lack of interest, to tell the truth difficult to prove, expressed by citizens concerned about decisions that they consider urgent and that last over time about acts of violence against women, complaints of gender discrimination, investigations into aspects of drug trafficking and related persons, unclear deaths of criminals, and escapes of criminals on the verge of the inexplicable. Oh, and the already grueling process called «Operation Ocean» is still in full view.

Hace algunos años, cuando la ciudadanía parecía atacada de una cierta comezón, surgía un vocero de la Suprema Corte de Justicia para atender a los periodistas y dar explicaciones técnicas en lenguaje sencillo de qué ocurría en cada caso. Es verdad que ese vocero, quien ha desaparecido de la faz de la tierra sin que al menos yo tenga una explicación, sonaba monocorde y, sobre todo, escueto, incluso lacónico. Pero quienes buscábamos información para difundirla con responsabilidad entre la población algo teníamos para decir de fuente oficial, más allá de cuánto pudiésemos añadir de investigaciones propias.

A few years ago, when citizens seemed to be attacked by a certain itch, a spokesman for the Supreme Court of Justice appeared to attend to journalists and give technical explanations in plain language of what happened in each case. It is true that that spokesman, who has disappeared from the face of the earth without at least me having an explanation, sounded monotonous and, above all, concise, even laconic. But those of us who were looking for information to disseminate it responsibly among the population had something to say from an official source, beyond how much we could add from our own investigations.

No menos cierto es que hoy día, cuando la difusión noticiosa es mayor, permeada además por la influencia nada constructiva de las redes sociales, hay magistrados, en particular fiscales, hoy encargados de investigar las denuncias, que se prestan con una asiduidad novedosa y muy útil a los requerimientos periodísticos.

It is no less true that today, when the news coverage is greater, permeated also by the unconstructive influence of social networks, there are magistrates, in particular prosecutors, today in charge of investigating complaints, who are provided with a new and very regular assiduity. useful for journalistic requirements.

Pero la cuestión es que los procesos en general, y excluyo el procedimiento “abreviado” de los acuerdos entre la defensa y quien encabeza la acusación, conservan ese paso de tortuga que, en realidad, tiene tanta antigüedad como mayor es una exposición pública que no se imaginó años o décadas antes.

But the point is that the processes in general, and I exclude the «abbreviated» procedure from the agreements between the defense and whoever heads the prosecution, preserve that turtle step that, in reality, is as old as the greater is a public exhibition that does not imagined years or decades before.

Hay algo más, esgrimido por miembros de diferentes sectores que están involucrados en todo esto.

Es lo que ha dicho la Asociación de Defensores de Oficio, admitiendo a los cuatro vientos que sus integrantes están desbordados y no dan abasto a los requerimientos de los ciudadanos que, por razones económicas, deben requerir sus servicios.

This is what the Association of Public Defenders has said, admitting from the rooftops that its members are overwhelmed and cannot meet the requirements of citizens who, for economic reasons, must require their services.

Es lo que ha dicho la Asociación de Fiscales, aportando incluso cifras que causan escalofríos de la cantidad de causas que, cada año, caen en sus manos. La gremial ha denunciado que no hay fiscalías suficientes, extremo agravado en el interior del país, ni quienes trabajan cuentan con los recursos imprescindibles para cumplirlo con otra celeridad y sin perder de vista el profesionalismo y la responsabilidad personal.

Observando el cierre de varios procesos de distintas características, muchos contribuyentes están multiplicando a voz en cuello una sensación que, aunque nada benevolente, lanzada al aire a veces sin apoyo en la verdad, o sea en hechos objetivos, probables, horada, quiérase o no, el prestigio del Poder Judicial: “Hay una justicia para pobres y otra para ricos”.

Observing the closure of several processes of different characteristics, many contributors are multiplying at the top of their lungs a feeling that, although not benevolent, is sometimes thrown into the air without support in the truth, that is, in objective, probable, pierced facts, like it or not. , the prestige of the Judiciary: «There is a justice for the poor and another for the rich.»

Yo no puedo afirmar eso, pero comprendo la inquietud y confusión de muchos, cuando se conocen determinadas sentencias. Sólo un ejemplo: al Betito, delincuente con profusos antecedentes como narcotraficante, lo condenaron, en un proceso abreviado, a dos años y medio de prisión que es quién sabe si llegará a cumplir en su totalidad, mientras a una mujer que traficó –madre sola de varios hijos que había quedado sin trabajo y, en su desesperación, introdujo unos gramos de marihuana en una cárcel- le cayó encima una pena de cuatro años.

I cannot affirm that, but I understand the concern and confusion of many, when certain sentences are known. Just one example: Betito, a criminal with a profuse history as a drug trafficker, was sentenced, in an abbreviated process, to two and a half years in prison, which is who knows if he will serve in full, while a woman who trafficked – single mother of several children who had been left without work and, in desperation, put a few grams of marijuana in a prison – he was sentenced to four years.

Sí, ya lo sé: parecen especulaciones de quienes ignoran las circunstancias del trabajo judicial. Puede ser que sea así. Pero no hay que despreciar el modo, en variopintos casos imperfecto o inacabado, como se enteran los vecinos de cuánto ocurre en las sedes judiciales y de las imputaciones tanto como de las sentencias.

Yes, I know: they seem like speculations of those who are ignorant of the circumstances of judicial work. It might be so. But we must not despise the way, in various cases imperfect or unfinished, as the neighbors find out about what happens in the judicial headquarters and the imputations as well as the sentences.

No es una cuestión sencilla.

It is not a simple matter.

Analizada hasta donde puedo, me prendo como garrapata de dos aspectos que ya he comentado: el Nuevo Código del Proceso Penal, pensando para una cosa terminó siendo otra, entreverando y agravándolo todo; es tarea de los legisladores, de una vez por todas, corregir las imperfecciones. El otro asunto es la independencia del Poder Judicial; no será real mientras deba negociar, cada período, los recursos que necesita con el Poder Ejecutivo para luego consagrarlos a través del Poder Legislativo. Es decir, la posibilidad de resolver su propio presupuesto, atendiendo a todas las necesidades, sería el sello lacrado de su autonomía indiscutible.

Analyzed as far as I can, I catch myself as a tick of two aspects that I have already commented: the New Code of Criminal Procedure, thinking for one thing ended up being another, intertwining and aggravating everything; it is the task of legislators, once and for all, to correct imperfections. The other issue is the independence of the Judiciary; It will not be real while it must negotiate, each period, the resources it needs with the Executive Power and then consecrate them through the Legislative Power. In other words, the possibility of solving their own budget, attending to all needs, would be the seal of their indisputable autonomy.

¿Por qué? / Why?

Pues, amable lector, da hasta pena ver cómo sufren, desde los integrantes de la Suprema Corte de Justicia hasta el último funcionario del Poder Judicial, tratando de cumplir sus valiosísimas actividades, esenciales en una democracia republicana, sin tener la cantidad de sedes necesarias, ni la estructura tecnológica debida, ni la cantidad de trabajadores que se requieren.

Well, kind reader, it is even sad to see how they suffer, from the members of the Supreme Court of Justice to the last official of the Judicial Power, trying to carry out their invaluable activities, essential in a republican democracy, without having the necessary number of seats, neither the due technological structure, nor the amount of workers required.
