THE THINKER: UNNECESSARY SKIRMISH

En Uruguay, y sospechosamente cuando se ha desatado una estrafalaria campaña prelectoral, un proyecto de ley ha provocado que oficialismo y oposición se encarnicen en un debate poco menos que decimonónico (por ser benevolente): la Ley de Medios.

In Uruguay, and suspiciously when a bizarre pre-election campaign has been unleashed, a bill has caused the ruling party and the opposition to get into a debate that is little less than nineteenth-century (because it is benevolent): the Media Law.

En realidad, para que nadie se llame a confusión, ya hay una Ley de Medios vigente, o sea que lo que se está debatiendo es una profunda revisión y cambios de ese texto.

In reality, so that no one is confused, there is already a Media Law in force, meaning that what is being debated is a profound review and changes to that text.

El lío principal, además de la extensión y notoria complejidad del proyecto a estudio, presentado con cierto apuro ahora, nace de lo que yo llamaría riesgos -que existen- pero que los opositores dan por hechos casi consumados si hay aprobación, vinculados al impulso a la concentración de la propiedad de los medios y una enmarañada, por momentos ingenua lista de controles que interferirían con la libertad de prensa consagrada en la Constitución.

The main mess, in addition to the extension and notorious complexity of the project under study, presented with some haste now, arises from what I would call risks – which exist – but which opponents consider almost accomplished facts if there is approval, linked to the impulse to the concentration of media ownership and a tangled, at times naive list of controls that would interfere with the freedom of the press enshrined in the Constitution.

Antes de reflexionar acerca de otros aspectos, porque en los mencionados hay mucho de novelería -parte inocua- e interferencia -parte mala-, diré lo que he dicho desde que me inicié en el periodismo, hace más de seis décadas. Es una frase que pertenece a un colega y amigo, Danilo Arbilla, prestigioso periodista: “No hay mejor Ley de Medios que la que no se escribe”; no es una expresión ingeniosa en un momento caliente de una discusión; se ajusta a lo que para mí es una realidad: la Constitución no sólo protege la libertad de información, sino también, por ejemplo a través del Código Penal, determina claramente cuando esa libertad excede límites razonables, por ejemplo incursionando en la injuria, la difamación o la mentira que intenta crear supuestas verdades con daño social.

Before reflecting on other aspects, because in those mentioned there is a lot of novelty – part harmless – and interference – part bad -, I will say what I have said since I started in journalism, more than six decades ago. It is a phrase that belongs to a colleague and friend, Danilo Arbilla, a prestigious journalist: “There is no better Media Law than the one that is not written”; It is not a witty expression at a hot moment in an argument; conforms to what for me is a reality: the Constitution not only protects freedom of information, but also, for example through the Penal Code, clearly determines when that freedom exceeds reasonable limits, for example by engaging in libel, defamation or the lie that tries to create supposed truths with social damage.

La diferencia, también real, entre la afirmación de Arbilla, que sigo compartiendo, y el presente, es el avance muy veloz y complejo del proceso de comunicación a través de la tecnología en constante cambio. Hoy debe tenerse en cuenta, para empezar una nueva discusión, todo lo que entra en la olla de internet (incluida la “inteligencia artificial”) y que, día a día, también se modifica y plantea nuevos escenarios que no pasan desapercibidos.

The difference, also real, between Arbilla’s statement, which I continue to share, and the present, is the very rapid and complex advancement of the communication process through constantly changing technology. Today we must take into account, to start a new discussion, everything that enters the internet pot (including “artificial intelligence”) and that, day by day, is also modified and poses new scenarios that do not go unnoticed.

Ahí sí hay que intervenir para actualizar las normas constitucionales y las leyes. Carezco de toda la información y conocimiento acerca de esta área; creo que lo mismo les pasa a muchos de los legisladores que vociferan de un lado y otro de la política. Bueno, ellos tienen la obligación de prepararse, de consultar a técnicos y especialistas, insumiendo el tiempo que sea, y luego, cuando sepan de qué cuernos están hablando, tomar decisiones. Está claro que este limpio proceso llevará mucho tiempo: cualquier proyecto de cualquier partido político que llegue a las próximas elecciones será, lamento decirlo, “un boletito jugado a la quiniela”.

There we must intervene to update the constitutional norms and laws. I lack all the information and knowledge about this area; I think the same thing happens to many of the legislators who shout from one side of politics to the other. Well, they have the obligation to prepare, to consult technicians and specialists, taking whatever time, and then, when they know what the hell they are talking about, make decisions. It is clear that this clean process will take a long time: any project of any political party that reaches the next elections will be, I am sorry to say, “a ticket played in the pool.”

Por eso, un modesto consejo para los inquietos: estudien, consulten, debatan con la ética del postulado por sobre la idea de dogma y quizás surja, con el tiempo, algo consensuado que sea una mejora que no afecte libertades ni derechos del periodismo.

Therefore, a modest piece of advice for the restless: study, consult, debate with the ethics of the postulate over the idea of ​​dogma and perhaps, over time, something consensual will emerge that is an improvement that does not affect freedoms or rights of journalism.

Mientras tanto -Arbilla dixit- “la mejor Ley de Medios es la que no se escribe”.
