THE THINKER: HE IS NOT BLIND WHO DOESN’T WANT TO SEE

A medida que la sociedad uruguaya se va introduciendo en la campaña electoral con mira en las próximas elecciones, se va produciendo un cacareo aquí y allá acerca de los problemas que se mantienen sin solución.

As Uruguayan society enters the electoral campaign with an eye on the next elections, there is a cackling here and there about the problems that remain unsolved.

Estamos acostumbrados a que en este contexto haya cambios, a medida que se calienta esa campaña y encuestadoras, analistas políticos, candidatos diversos y, por consecuencia, la mayoría de la población, cambia la mira del arma de sus inquietudes y aparecen otras.

We are accustomed to changes in this context, as the campaign heats up and pollsters, political analysts, diverse candidates and, consequently, the majority of the population, change the sights of their concerns and others appear.

Pero hay una que, estoy persuadido, se mantendrá durante toda la campaña. Entre otras cosas porque se ha convertido en un virus de veloz expansión y en extremo peligroso: la inseguridad y la incidencia prepotente y corrupta de las organizaciones delictivas y del narcotráfico entre niños y jóvenes, manejada desde las propias cárceles, donde es habitual que los jefecitos de lo que sea ordenen, ¡a través del uso de celulares¡, los movimientos de sus soldaditos.

But there is one that, I am convinced, will remain throughout the campaign. Among other things, because it has become a rapidly expanding and extremely dangerous virus: insecurity and the arrogant and corrupt incidence of criminal organizations and drug trafficking among children and young people, managed from the prisons themselves, where it is common for the bosses whatever they order, through the use of cell phones!, the movements of their little soldiers.

Me resulta cuanto menos curioso que la mayoría de los supuestamente entendidos repitan como obstáculo central de una posible solución argumentos como: el hacinamiento en las cárceles, porque si crece su población, terminará reproduciendo la delincuencia; las cárceles que carecen de infraestructura, y de una planeación realista, para ser vistas como centros de castigo pero también de rehabilitación; o “hay que aplicar mejor las penas”, sobre todo las acordadas previamente por los acusados con la Fiscalía actuante, para que, en casos que admita el Código del Proceso Penal, eviten contribuir al hacinamiento de los principales centros de detención en situación crítica.

I find it curious, to say the least, that the majority of supposedly knowledgeable people repeat arguments such as: overcrowding in prisons as a central obstacle to a possible solution, because if their population grows, it will end up reproducing crime; prisons that lack infrastructure and realistic planning to be seen as centers of punishment but also rehabilitation; or “sanctions must be better applied”, especially those previously agreed upon by the accused with the acting Prosecutor’s Office, so that, in cases admitted by the Code of Criminal Procedure, they avoid contributing to the overcrowding of the main detention centers in critical situations.

Se me hace que detrás de todos estos argumentos sólo evitan enfrentar la solución que el escenario actual exige: hay que construir más cárceles -más modernas, seguras y de menor tamaño- dispuesta cada una para poblaciones específicas: los narcos deben estar en una de ellas, bajo un sistema que impida totalmente su contacto con el exterior y un régimen interno, incluidas las visitas, de extrema v severa vigilancia. En otra, deberán quedar los reincidentes y los culpables de crímenes graves, bajo un control similar. Finalmente, debería crearse una cárcel específica para pedófilos, violadores, pornógrafos, etcétera.

It seems to me that behind all these arguments they only avoid facing the solution that the current scenario demands: we must build more prisons – more modern, safe and smaller in size – each one arranged for specific populations: the drug traffickers must be in one of them. , under a system that totally prevents contact with the outside world and an internal regime, including visits, of extreme and severe surveillance. In another, repeat offenders and those guilty of serious crimes must be placed under similar control. Finally, a specific prison should be created for pedophiles, rapists, pornographers, etc.

¿Y la rehabilitación?

And rehabilitation?

Ah, claro. En ese ámbito estamos, para decirlo en criollo básico, en calzoncillos. Son necesarios varios centros de rehabilitación, con tamaño, infraestructura y atención de la personalidad de los detenidos beneficiados como habitantes de ellos. Aquí también es necesaria la variedad, porque su población, desde el punto de vista etario, sería muy variada: desde los doce a los dieciocho años -previo modificar la ley que establece hoy el límite mínimo en dieciséis-, por un lado, y los mayores de edad por el otro.

Oh, sure. In that area we are, to put it in basic Creole, in our underwear. Several rehabilitation centers are necessary, with size, infrastructure and attention to the personality of the detainees who benefit as inhabitants of them. Variety is also necessary here, because its population, from an age point of view, would be very varied: from twelve to eighteen years old – after modifying the law that today establishes the minimum limit at sixteen -, on the one hand, and of legal age on the other.

Soy consciente de que todo este proceso insumirá millones de dólares de inversión. El Estado, en las actuales circunstancias no puede enfrentar ese desafío; por lo tanto queda, como en tantos otros países, perder el miedo a rozarse con el capital privado y poner a trabajar en esto al Programa Público Privado de Inversiones.

I am aware that this entire process will require millions of dollars of investment. The State, in the current circumstances, cannot face that challenge; Therefore, as in so many other countries, we must lose the fear of coming into contact with private capital and put the Public Private Investment Program to work on this.

Invierte un fondo privado, quien costea todas las obras, y recibe luego un canon y beneficios impositivos para equilibrar con los años el dinero que puso. Está claro que la administración y el funcionamiento deberán ser creados, regulados y vigilados por el Estado.

A private fund invests, which pays for all the works, and then receives a fee and tax benefits to balance the money it put in over the years. It is clear that the administration and operation must be created, regulated and monitored by the State.
