THE THINKER: SMALL DETAILS, BIG PROBLEMS

Cuando hablamos de mejorar la convivencia en nuestra sociedad, lo primero que hay que entender se resume en una frase de nivel escolar por más que ahí está la raíz de muchos malentendidos y conflictos: “Mis derechos pueden llegar hasta el límite donde comienzan los derechos de los demás”. Todos tenemos constitucionalmente derechos en Estado democrático, tanto como obligaciones, pero para unos y otras nadie ignora que existen límites.

When we talk about improving coexistence in our society, the first thing to understand is summed up in a school-level phrase, even though that is the root of many misunderstandings and conflicts: “My rights can reach the limit where the rights of others». We all have constitutional rights in a democratic State, as well as obligations, but for both, no one ignores that there are limits.

El problema es que está claro que si algo se va desdibujando progresivamente, con daños múltiples al tejido social, es la benevolencia. O sea la actitud de cada uno de entender que, del mismo modo que puede reclamar por un derecho establecido, no le está permitido pisotear el de los otros, ya sea por prepotencia, egoísmo, arrogancia o desconocimiento de las normas que pretenden ordenar la vida en comunidad. Día a día, de múltiples formas y en múltiples actitudes, se advierte que crece la corriente contraria, la malevolencia, causa de gran cantidad de confrontaciones cotidianas, algunas que, vistas en su esencia, son una reverenda estupidez o un capricho idiota.

Day by day, in multiple forms and in multiple attitudes, it is noted that the contrary current grows, malevolence, the cause of a large number of daily confrontations, some of which, seen in their essence, are reverend stupidity or an idiotic whim.

Por estos días, donde hay tantos asuntos que deberían concentrar toda nuestra atención –reforma de la educación, proyecto de nuevo régimen de seguridad social, la economía cuyo ascenso no es suficiente por ahora, el crecimiento de la marginalidad y la pobreza y la inseguridad, entre otros- ha reaparecido uno que fue, en tiempo pasado no tan lejano, un obstáculo para la sana convivencia y un impulso para el enfurecimiento y una convivencia irrespirable: la llamada “tenencia responsable de animales domésticos en edificios de propiedad horizontal”. No hay asamblea de copropietarios de cualquiera de estos sitios, donde esta cuestión no sólo figure repetidamente, sino que desate las polémicas más agresivas que uno pueda imaginar.

There is no assembly of co-owners of any of these sites, where this question not only appears repeatedly, but also unleashes the most aggressive controversies one can imagine.

Si hablamos de leyes, aparece una curiosidad que parece asimismo hija de la incapacidad asombrosa de nuestros parlamentarios: todo creyó ser zanjado cuando se aprobó a Ley de Protección, Bienestar y Tenencia de Animales, que fija reglas para las características de una “tenencia responsable” (intríngulis maravilloso que nadie sabe, a ciencia cierta, qué quiere decir), reglas que, según quien lea o adivine lo escrito en esa ley “permitiría la cohabitación con la mascota elegida”.

If we talk about laws, a curiosity appears that also seems to be the result of the amazing incapacity of our parliamentarians: everything was thought to be resolved when the Law for the Protection, Welfare and Ownership of Animals was approved, which sets rules for the characteristics of «responsible ownership» (wonderful intricacies that nobody knows for sure what it means), rules that, according to whoever reads or guesses what is written in that law, «would allow cohabitation with the chosen pet.»

Ya esto es suficiente para atragantarse y vomitar, pero apareció un legislador con un proyecto correctivo con el fin de evitar que se impida la tenencia de animales. ¿A santo de qué surgió semejante iluminación intelectual de este señor? Ocurre que muchos edificios, en sus reglamentos internos fijados por asamblea, tienen prohibiciones específicas de tenencia o multas significativas a quienes incumplan la “tenencia responsable”.

This is already enough to choke and vomit, but a legislator appeared with a corrective project in order to avoid preventing the possession of animals. What did such an intellectual illumination of this gentleman come from? It happens that many buildings, in their internal regulations set by the assembly, have specific prohibitions on ownership or significant fines for those who fail to comply with «responsible ownership».

Es decir, dejamos que cualquier habitante de estos edificios –sean altos o medianos, de apartamentos grandes o pequeños, con muchas personas mayores habitándolos o una comunidad variopinta- pueda convivir con su gato, su perro de cualquier raza y tamaño, su monito simpático, sus loros parlanchines o hasta su lagarto de dimensiones apropiadas al sitio destinado a su vida de ciudad. En ciertos casos la negativa es radical; en otros, se da el permiso pero la vigilancia es férrea y los incumplimientos generan multas a veces mayores que los propios gastos comunes.

In certain cases the refusal is radical; in others, permission is given but vigilance is strict and non-compliance generates fines that are sometimes greater than the common expenses themselves.

Yo tengo abundante experiencia en edificios de propiedad horizontal. And, above all, living with other animals, the kind that screw up one’s existence despite all the warnings and even despite all the fines. The result is a place where perhaps tens or hundreds of families live in a time bomb climate about to explode; no one pays attention to anyone. Each one goes forward, like a crusader, blinded by the belief that the only untouchable right is theirs. The result is a kind of daily combat, which does not exclude shouting, or struggles, or threats of police or criminal charges. Multiply you, reader, this sad scenario by the number of buildings in such a situation and tell me if we are not helping society to be less and less respectful, more intolerant and malevolence grows.
