COLOMBIA: MALESTAR INTERNACIONAL POR ACCIONAR DE SUPERSOCIEDADES BARRANQUILLA A «LA LIBERTAD»

In Colombia Barranquilla, a probable «blind eye» of the respective authorities, as well as the total vulnerability of the rights to which the Companies that make up the Media Conglomerate with the Radio Chain of La Libertad and El Diario La Libertad are among those most affected by the systematic irregular and reckless actions of the Superintendency of Companies based in Barranquilla.

En Colombia Barranquilla, una probable «de la vista gorda» de las autoridades respectivas, así como la total vulnerabilidad de los derechos a los que le asisten a las Empresas que conforman el Conglomerado de Medios de Comunicación con la Cadena Radial de La Libertad y El Diario La Libertad entre los más damnificados por el sistemático proceder irregular y temerario accionar de la Superintendencia de Sociedades sede Barranquilla.

It should be noted that this is not the first time that the Superintendency of Companies has attacked the aforementioned companies that constitute true assets of the city of Barranquilla, as the citizens themselves have recognized for a long time,
well-known personalities from the place as well as from the country itself and now from abroad who also recognize him as such, where this news came as a complaint against the assisted rights that are violated to this emblematic medium that was born for its people and by its people, therefore, we would be talking about THE VULNERATION OF THE RIGHTS OF THE PEOPLE where they literally intend to coerce to his La Libertad.

Cabe resaltar que no es la primera vez que la Superintendencia de Sociedades arremete contra las mencionadas empresas que se constituyen en verdaderos patrimonios de la ciudad de Barranquilla, tal como lo han reconocido desde mucho tiempo atrás la propia ciudadanía, personalidades de bien del lugar como del propio país y ahora desde el Extranjero que también le reconocen como tal, en donde esta noticia llegó cual denuncia contra los derechos asistidos propios que le son vulnerados a este medio emblemático que nació para su pueblo y por su pueblo por lo tanto, estaríamos hablando de LA VULNERACIÓN DE LOS DERECHOS DEL PUEBLO en donde de forma literal pretenden coactar a su La Libertad.

Apparently, there is NO justification in the attitude assumed by the aforementioned entity, if it is taken into account that the arguments put forward to support their irregular intervention, they do not adhere to the norms established for this type of procedure, so we could be talking about a flagrant crime of abuse of authority and power, therefore this matter lacks any normative support.

Al parecer, no existe NINGUNA justificación en la actitud asumida por la señalada entidad, si se tiene en cuenta que los argumentos que se esgrimen para sustentar su irregular intervención, no se ciñen a las normas establecidas para esta clase de procedimientos, por lo que podríamos estar hablando de un flagrante delito de abuso de autoridad y de poder por tanto este asunto carece de todo respaldo normativo.

It is known that one of the functions of this Superintendence of Companies consists of advising the National Government and participating in the formulation of policies in all those aspects that have to do with inspection, surveillance and control of commercial companies and sole proprietorships. Being in principle to exercise, in accordance with the law, the inspection, surveillance and control over commercial companies, branches of foreign companies, sole proprietorships and any other determined by law. However, all of the foregoing that in the case of the media does not govern these functions, so that in the specific case referred to, it is not susceptible to the intervention of the aforementioned Superintendency, so it is easy to conclude that the aforementioned entity is acting in the wrong way, which has generated great confusion in the foreign media due to the bad image that this represents.

Se sabe que una de las funciones de esta Superintendencia de Sociedades consiste en asesorar al Gobierno Nacional y participar en la formulación de las políticas en todos aquellos aspectos que tengan que ver con la inspección, vigilancia y control de las sociedades comerciales y empresas unipersonales. Siendo en principio la de ejercer, de acuerdo con la ley, la inspección, vigilancia y control sobre las sociedades comerciales, sucursales de sociedad extranjera, empresas unipersonales y cualquier otra que determine la ley. No obstante, todo lo anteriormente expuesto que para el caso de los medios de comunicación no rigen estas funciones por lo que en el caso específico al que se hace referencia no es susceptible de la intervención de la señalada Superintendencia, por lo que resulta fácil concluir que la referida entidad está actuando de manera equivocada, lo que ha generado gran confusión en los medios extranjeros por la mala imagen que esto representa.

It draws attention and is something that can be clarified by the high command of the aforementioned institution, in the sense that what are the arguments that support the erroneous decisions recently made by said Superintendence in which the media Cadena Radial de la Libertad and Diario La Libertad are involved, administrative acts that cause immense damages to the entities to which we refer today.

Llama la atención y es algo susceptible de aclaración por parte de los altos mandos de la mencionada institución, en el sentido que cuáles son los argumentos que le sirven de sustento a las equivocadas decisiones recientemente proferidas por dicha Superintendencia en las que se involucran a los medios de comunicación Cadena Radial de la Libertad y Diario La Libertad, actos administrativos con los que se causan inmensos perjuicios a las entidades a las que hoy hacemos referencia.

The attitude assumed by the aforementioned institution leaves many doubts,
With regard to the position assumed regarding possible sanctions, if we take into account that not a single iota of vulnerability is visible on the part of the aforementioned companies, therefore, the attitude assumed by the Superintendency of Companies violates the regulations that governs in matters of the media, as is the case.

La actitud asumida por la señalada institución deja muchas dudas, en lo atinente a la posición asumida respecto a las posibles sanciones, si tenemos en cuenta que no se vislumbra un solo ápice de vulnerabilidad por parte de las señaladas empresas, por lo que la actitud asumida por la Superintendencia de Sociedades es violatoria de la normatividad que rige en materia de medios de comunicación, como es el caso.

It would be pertinent for the Superintendency of Companies to carefully review this case, if we take into account that an unjustified intervention such as the one that is intended to be carried out on the aforementioned media, would cause damages not only economic but also of a moral nature of incalculable proportions, if we take into account the immeasurable cultural value that they represent.

Sería pertinente que la Superintendencia de Sociedades proceda a revisar detenidamente este caso, si tenemos en cuenta que una injustificada intervención como la que se pretende llevar a cabo a los medios de comunicación antes mencionados, ocasionaría perjuicios no solamente económicos sino igualmente de carácter moral de incalculables proporciones, si tenemos en cuenta el inconmensurable valor cultural que ellos representan.

The call made today by this media conglomerate is the same from the citizens of Barranquilla and the Caribbean Coast in general as from the Foreign Press: «Do not stop rejecting the attitude assumed by the aforementioned Superintendency, which has been cruel against our media, so we hope it is an error that can be corrected as soon as possible.»

El llamado que hoy hace este conglomerado de Medios, es el mismo de la ciudadanía barranquillera y de la Costa Caribe en general como de la Prensa Extranjera: «No dejen de rechazar la actitud asumida por la citada Superintendencia, que se ha ensañado contra nuestros medios de comunicación, por lo que esperamos se trate de un error que pueda ser subsanado lo antes posible».
