THE THINKER: DEPENDENT JUSTICE

Según declaraciones recientes de integrantes de la Asociación de Magistrados del Uruguay, la justicia nacional, desde el punto de vista presupuestal, carga con más de una década de atraso en su necesidad de aproximarse al presupuesto racional que necesita para cumplir con su vital cometido en una democracia republicana.

En reflexiones anteriores, y en reiteración real, no sólo me he anticipado a estos reclamos, lo que no representa otro mérito que el de la responsabilidad ciudadana, sino que he dicho con meridiana claridad que el Poder Judicial no es integralmente independiente, como exige la Constitución, pues no tiene más que la relativa fuerza de las argumentaciones de la Suprema Corte para obtener los recursos económicos y también de infraestructura que necesita, frente a una decisión final que se cuece entre el Poder Ejecutivo, que presenta el Presupuesto Nacional, y el Poder Legislativo que lo aprueba o lo corrige a través de unas restricciones negociadas por los políticos.

In previous reflections, and in real reiteration, I have not only anticipated these claims, which represents no other merit than that of citizen responsibility, but I have said with crystal clarity that the Judiciary is not fully independent, as required by law. Constitution, since it has nothing more than the relative strength of the arguments of the Supreme Court to obtain the economic resources and also the infrastructure that it needs, in the face of a final decision that is cooked between the Executive Branch, which presents the National Budget, and the Legislative Branch that approves or corrects it through restrictions negotiated by politicians.

Durante las últimas semanas, por si hiciera falta, se han concentrado una cantidad de casos en juzgados de distintos ámbitos que confirman la patología no atendida: por todos lados aparecen fiscales y jueces –en sedes penales abarrotadas de expedientes, cuestión que ya se introduce en el absurdo- que han elevado su inevitable cuota de errores, distracciones o apresuramientos, sin lograr otra cosa que fallos controvertidos, algunos con estatura de escandalosos, consumiendo un tiempo exageradísimo para cerrar cada proceso.

In recent weeks, if necessary, a number of cases have been concentrated in courts from different areas that confirm the unaddressed pathology: prosecutors and judges appear everywhere – in criminal offices packed with files, an issue that is already being introduced in the absurd – that have increased their inevitable quota of errors, distractions or haste, without achieving anything other than controversial rulings, some of scandalous stature, consuming an exaggerated amount of time to close each process.

El caso “estrella” de los últimos días ha sido el narcotraficante, encarcelado luego de una prolija  y vigorosa investigación, quien, por un recurso mentiroso, corrupto -que ha llevado ahora a la cárcel a una de sus abogadas- indujo a la magistrada a cargo de otorgarle al peligroso delincuente la “prisión domiciliaria con tobillera incluida” por lo que luego se probó eran falsas razones de salud. Por otro lado, no hubo atención policial inmediata sobre el individuo, ni tampoco tobillera a tiempo. Fin de la novela: el narcotraficante se fugó con olímpica facilidad y ahora se lo busca, supongo, hasta en Burkina Faso.

The “star” case of recent days has been the drug trafficker, imprisoned after a lengthy and vigorous investigation, who, through a lying, corrupt appeal – which has now taken one of his lawyers to jail – induced the magistrate to charge of granting the dangerous criminal “house arrest with anklets included” for what were later proven to be false health reasons. On the other hand, there was no immediate police attention to the individual, nor an ankle bracelet in time. End of the novel: the drug trafficker escaped with Olympic ease and now he is wanted, I suppose, even in Burkina Faso.

Es un ejemplo. Pero estos casos, las demoras y las desprolijidades de los procesos se están multiplicando de tal modo que uno, ciudadano común, siente como si acá se hubiese instalado la perversa y dañina “teoría Zaffaroni”, así llamada por la idea del académico argentino de benevolencia con los delincuentes “pues es responsabilidad de la propia sociedad que no les haya dado toda la atención necesaria para convertirse en personas honestas” (aclaro que estoy simplificando la idea del nefasto jurista mencionado).

But these cases, the delays and the sloppiness of the processes are multiplying in such a way that one, an ordinary citizen, feels as if the perverse and harmful “Zafaroni theory” has been installed here, named after the Argentine academic’s idea of ​​benevolence. with criminals «since it is the responsibility of society itself that it has not given them all the attention necessary to become honest people» (I clarify that I am simplifying the idea of ​​the disastrous jurist mentioned).

Haya o no magistrados “zaffaronistas” entre nuestros jueces y fiscales y hasta entre integrantes de la Suprema Corte, el problema central, a mi modesto juicio, sigue siendo la falta de recursos económicos, personal bien preparado y suficiente e infraestructura adecuada. 

Whether or not there are “zaffaronist” magistrates among our judges and prosecutors and even among members of the Supreme Court, the central problem, in my modest opinion, continues to be the lack of economic resources, well-trained and sufficient personnel and adequate infrastructure.

¿Una lista sencilla, como de las que se hacen para ir al almacén? Bien: falta de presupuesto imprescindible para cumplir la tarea judicial sin disculpas de clase alguna; falta de personal bien preparado para las distintas actividades en los juzgados; carencia brutal de locaciones simplemente útiles para desarrollar el trabajo y asegurar a las víctimas y testigos y un trabajo decentes a los abogados de una parte y otra.

A simple list, like one you make to go to the store? Good: lack of budget essential to fulfill the judicial task without excuses of any kind; lack of well-trained personnel for the different activities in the courts; brutal lack of locations simply useful to carry out the work and ensure victims and witnesses and decent work for the lawyers of both parties.

Claro, siempre hay una frutillita para la torta: la absoluta falta de coherencia y coordinación entre el sistema judicial, el Ministerio del Interior, y el organismo que controla las cárceles, que, por otra parte, son miserablemente pocas y verdaderos despojos edilicios donde se entrevera todo. Narcotraficantes, sicarios, violadores, rateros, homicidas, contrabandistas y “ainda mais”.

Of course, there is always a little icing on the cake: the absolute lack of coherence and coordination between the judicial system, the Ministry of the Interior, and the body that controls the prisons, which, on the other hand, are miserably few and true building ruins where it blurs everything. Drug traffickers, hitmen, rapists, thieves, murderers, smugglers and “ainda mais”.

¡Y qué decir de locales apropiados para la separación de los encarcelados por simple sentido común y la insuficiencia de sitios y funcionarios suficientes para intentar la compleja tarea de la rehabilitación!

And what about appropriate premises for the separation of those imprisoned due to simple common sense and the lack of sufficient places and officials to attempt the complex task of rehabilitation!

Así, estamos perdidos.
