THE THINKER: THE DRAMA OF INSECURITY

En la región que habitamos del planeta –aunque la enfermedad se ha esparcido hasta sitios lejanos en los que no sabemos, ciertamente, qué ocurre- la inseguridad creciente y expansiva es la más dramática de las cuestiones sociales a enfrentar.

In the region we inhabit on the planet –although the disease has spread to distant places where we certainly do not know what is happening- the growing and expansive insecurity is the most dramatic of the social issues to be faced.

Hoy, la comunidad nacional vive en estado de conmoción ante la lluvia cotidiana de actos delictivos acerca de los cuales no hay que engañarse: cada vez más violentos y descarados van abarcándolo todo. Calles y veredas por donde circulan peatones a cualquier hora del día y lugar; comercios, hogares y sitios de esparcimiento; vehículos de cualquier tipo y, recientes casos lo avalan, hasta hospitales, escuelas y liceos.

Today, the national community lives in a state of shock before the daily rain of criminal acts about which one should not be deceived: more and more violent and brazen are encompassing everything. Streets and sidewalks where pedestrians circulate at any time of day and place; shops, homes and entertainment sites; vehicles of any type and, recent cases support it, even hospitals, schools and high schools.

Podría decirse, sin pretensión de ofensa al país vecino, que tenemos la desgracia de la estrecha vecindad con Argentina, donde este problema es muchísimo mayor al punto de poner en jaque a la parodia de gobierno actual que soporta, con la certeza de que el próximo cambio de autoridades lo recibirá como principal problema de sus antecesores junto al descalabro de la economía y la destrucción de los sistemas educativos y de salud.

It could be said, without intending to offend the neighboring country, that we have the misfortune of being close to Argentina, where this problem is much greater to the point of jeopardizing the parody of the current government that it supports, with the certainty that the next The change of authorities will receive it as the main problem of its predecessors together with the collapse of the economy and the destruction of the educational and health systems.

Menciono esto porque es tan cercano el vínculo, que no puede descartarse, al menos en ciertos ámbitos delictivos –como el del narcotráfico, por ejemplo- lo que uno llamaría el efecto “contagio” o el efecto “imitación”, que, en ambos casos, conducen al final del camino a una informal pero destructiva relación.

I mention this because the link is so close that it cannot be ruled out, at least in certain criminal areas -such as drug trafficking, for example- what one would call the «contagion» effect or the «imitation» effect, which, in both cases , lead to the end of the road to an informal but destructive relationship.

Claro, sobre lo ajeno poco podemos hacer. Lo inquietante es lo poco que estamos haciendo para enfrentar la cuestión a la medida de nuestra sociedad, de lo que ocurre dentro de los límites de nuestras fronteras.

Of course, we can do little about what belongs to others. What is disturbing is how little we are doing to address the issue to the extent of our society, of what happens within the limits of our borders.

Enunciados, proclamas, protestas, acusaciones cruzadas y tantos otros escapes de los responsables tenemos a montones. No sirven para nada. O, en todo caso, fomentan la pérdida de tiempo, la dureza de la intolerancia y la inutilidad de todo lo que se planea.

Statements, proclamations, protests, cross accusations and so many other escapes from those responsible we have in abundance. They are useless. Or, in any case, they promote the waste of time, the harshness of intolerance and the uselessness of everything that is planned.

No soy especialista, ni tengo la solución. Simplemente puedo expresar algunas ideas que quizás merezcan el respeto del análisis de otros ciudadanos. Lo primero que falla aquí son los servicios de inteligencia; sea porque son insuficientes o ineficientes, sea porque es más fácil de lo que se creía el infiltrarlos, sea porque la corrupción mordisquea salvajemente todo lo que quiere ponerse en pie, esos servicios son los primeros incapaces de hacer su tarea, que es la de determinar dónde, cuándo y qué está pasando, quienes están directamente involucrados y, a partir de un diagnóstico certero, reordenar los esfuerzos y las inversiones para mejorar tanto la prevención como la represión que, está claro, será indispensable.

I am not a specialist, nor do I have the solution. I can simply express some ideas that perhaps deserve the respect of the analysis of other citizens. The first thing that fails here are the intelligence services; either because they are insufficient or inefficient, or because it is easier than thought to infiltrate them, or because corruption savagely nibbles at everything that wants to stand up, these services are the first incapable of doing their task, which is to determine where, when and what is happening, who is directly involved and, based on an accurate diagnosis, reorganize efforts and investments to improve both prevention and repression, which, it is clear, will be essential.

Luego viene dos problemas que si no tuvieran aristas trágicas serían graciosos: primero, ver si podemos sacarnos de encima la “teoría Zaffaroni”, jurista que creó en el vecino país la filosofía del proceso penal “sensato”, “constructivo”, “rehabilitador”, inhibiendo otras iniciativas y perpetuando lo que ha dado en llamarse el “buenismo”. Así, se han limitado las posibilidades de acción de las fuerzas de seguridad, se han ablandado todos los aspectos del proceso penal y, de modo indirecto pero malicioso, se ha terminado por beneficiar a los victimarios desprotegiendo a las víctimas. Esta despreciable teoría ha echado alguna raíz en nuestra política.

Then comes two problems that would be funny if they didn’t have tragic edges: first, to see if we can get rid of the “Zaffaroni theory”, a jurist who created in the neighboring country the philosophy of the “sensible”, “constructive”, “rehabilitative” criminal process. , inhibiting other initiatives and perpetuating what has come to be called “goodism”. Thus, the possibilities of action of the security forces have been limited, all aspects of the criminal process have been softened and, in an indirect but malicious way, the perpetrators have ended up benefiting by leaving the victims unprotected. This despicable theory has taken some root in our politics.

No quiero extenderme porque percibo que estas consideraciones generarán un debate intenso, espero que con tolerancia y respeto. Por eso sintetizo algunas ideas madre:

I do not want to extend myself because I perceive that these considerations will generate an intense debate, I hope with tolerance and respect. That is why I synthesize some main ideas:

-Hay que modificar el Nuevo Código del Proceso Penal, anulando los arreglos posibles entre la defensa del delincuente y las fiscalías para disminuir las penas. Por tanto, corresponde decir que hay que endurecer esas penas.

-It is necessary to modify the New Criminal Procedure Code, annulling the possible arrangements between the defense of the offender and the prosecutors to reduce the penalties. Therefore, it is appropriate to say that these penalties must be toughened.

-Debido al hacinamiento y todo lo ocurre en las horribles cárceles que tenemos, hay que construir más, con la característica de que atiendan a la población seleccionada que las habilitará: por ejemplo, una para primarios, otra para reincidentes, otra para violadores, pedófilos y femicidas. Y todas, en casos que previas pericias psiquiátricas lo admitan, vinculadas a centros de rehabilitación profesionales. Sólo así se evitará entrevero malévolo que hoy reina en casi todas las cárceles, convertido en un efecto formidable de generación de aprendizaje, reincidencia y violencia mortal interna.

-Due to overcrowding and everything that happens in the horrible prisons that we have, we have to build more, with the characteristic that they serve the selected population that will enable them: for example, one for primary offenders, another for repeat offenders, another for rapists, pedophiles and femicides. And all, in cases that previous psychiatric expertise admits it, linked to professional rehabilitation centers. Only in this way will the malevolent interlude that today reigns in almost all prisons, become a formidable effect of generating learning, recidivism and internal deadly violence, be avoided.

-Debe crearse, ajustado a los objetivos que revelen los servicios de inteligencia, un reordenamiento de las fuerzas policiales disponibles, los sitios adecuados de las comisarías y los patrullajes por toda la ciudad, con apoyo real de las autoridades y preparación profesional y equipamiento moderno para el personal.

-Adjusted to the objectives revealed by the intelligence services, a reorganization of the available police forces, the appropriate sites for police stations and patrols throughout the city must be created, with real support from the authorities and professional preparation and modern equipment for the staff.

Y, finalmente, si alguna vez pudieran hacerse bien las cosas obvias en este país, paralelamente hay que motorizar de una buena vez una adecuada reforma de la educación, con la inclusión de los hogares y los niños desde la más temprana edad.

And, finally, if ever the obvious things could be done well in this country, at the same time, an adequate reform of education must be motorized once and for all, with the inclusion of homes and children from an early age.

¿Mucho pedir? ¿Quizás un sueño? Con honestidad respondamos: ¿no podemos hacerlo?
