THE THINKER: BEWARE, WRONG PATH

Días atrás, durante un reportaje apresurado y disperso entre varios periodistas, el electo presidente Yamandú Orsi no descartó, sin profundizar al respecto, la posibilidad de que, entre los proyectos de su gobierno, figurase la creación -¡otra vez!- del Ministerio de Justicia.

Days ago, during a hasty and dispersed report among several journalists, the elected president Yamandú Orsi did not rule out, without elaborating on the matter, the possibility that, among his government’s projects, the creation – again! – of the Ministry of Justice.

A eso me referiré. Por supuesto lo haré de modo muy sintético porque en torno a estos institutos abundan los antecedentes, cambios de nombre y función, fechas, etcétera. Pero seré preciso en lo esencial y, sobre todo en mis ideas.

That’s what I’ll refer to. Of course I will do it in a very synthetic way because there is an abundance of antecedents around these institutes, changes in name and function, dates, etc. But I will be precise in the essentials and, above all, in my ideas.

El Ministerio de Justicia tiene su más antiguo antecedente histórico en un decreto de 1847 que creó el Instituto de Instrucción Pública.

The Ministry of Justice has its oldest historical precedent in a decree of 1847 that created the Institute of Public Instruction.

En 1883, una ley derogó ese decreto y creó el Ministerio de Justicia, Culto e Instrucción Pública que, a lo largo de las décadas tuvo muchos otros nombres y modificación de funciones.

In 1883, a law repealed that decree and created the Ministry of Justice, Worship and Public Instruction which, over the decades, had many other names and modified functions.

Me parece relevante recordar que, a partir de la última dictadura, la creación de un Ministerio de Justicia fue un arma letal de los militares para controlar a un Poder Judicial que, de todos modos, ya estaba bastante asfixiado.

It seems relevant to me to remember that, starting with the last dictatorship, the creation of a Ministry of Justice was a lethal weapon of the military to control a Judicial Branch that, in any case, was already quite suffocated.

Obviamente, esa herramienta institucional desapareció a partir de la restauración de la democracia que, recién en 2015, creyó aclarar el panorama confuso de la relación de los fiscales con la Suprema Corte y los magistrados en general: se instaló la Fiscalía General de la Nación, un nexo entre el poder Ejecutivo y el Ministerio de Educación.

Obviously, this institutional tool disappeared after the restoration of democracy which, only in 2015, believed to clarify the confusing panorama of the relationship between prosecutors and the Supreme Court and magistrates in general: the Attorney General’s Office was installed, a link between the Executive branch and the Ministry of Education.

Así estamos hoy y, aparentemente, nadie ha pensado sostener ese régimen añadiendo un Ministerio de Justicia. Bueno, al menos hasta Orsi, por lo que se ve. ¿Qué funciones tendría? ¿Hasta dónde podría contribuir a limitar la independencia del Poder Judicial? ¿Cuál es la necesidad de introducir siquiera la hipótesis de un organismo que será siempre sospechable de interferencias con el funcionamiento actual de la Justicia?

This is how we are today and, apparently, no one has thought of sustaining that regime by adding a Ministry of Justice. Well, at least until Orsi, from the looks of it. What functions would it have? To what extent could it contribute to limiting the independence of the Judiciary? What is the need to even introduce the hypothesis of an organization that will always be suspected of interference with the current functioning of Justice?

Ciertamente, el sistema judicial uruguayo, en los últimos años, ha admitido estar desbordado, demora más que en el pasado sus fallos y se han conocido casos de mal funcionamiento -con las sanciones que establece la ley- de fiscales y jueces, incluyendo aislados pero inquietantes casos de corrupción.

Certainly, the Uruguayan judicial system, in recent years, has admitted to being overwhelmed, its rulings take longer than in the past and there have been known cases of poor functioning – with the sanctions established by law – of prosecutors and judges, including isolated but disturbing cases of corruption.

En última instancia, al menos para mí y ahora, el Poder Judicial NO es estrictamente independiente, porque, lisa y llanamente no tiene independencia económica, la que depende de sus gestiones ante el Ejecutivo y el Parlamento.

Ultimately, at least for me and now, the Judiciary is NOT strictly independent, because, quite simply, it does not have economic independence, which depends on its efforts before the Executive and Parliament.

En fin. El régimen no es perfecto ni mucho menos, pero confiable. Y sobre todo necesario.

In the end. The regime is by no means perfect, but reliable. And above all necessary.

No creo, bajo punto de vista alguno, que ayude a mejoramiento alguno la creación, que me parece un delirio, por no decir otra cosa que muchos tal vez piensen.

I do not believe, from any point of view, that creation helps any improvement, which seems to me to be a delusion, to say the least that many may think.

Espero que el bueno de Orsi no meta la pata.

I hope good old Orsi doesn’t screw up.
